OK here are the facts as I see it. Take them anyway you want them.
The lay-off occurred on August 6th, it is now November 7th. We have hit the 3 month mark. In that 3 months any bank account that GH has with DSI's name has been seized to pay back the almost $18 million in loans, penalties and interest. GH still owes just about half to the banks. (not to mention he has racked up attorney's fees and may be held responsible for paying those too)
500 employees were part of that lay-off and still have not been made whole with their pay, expenses, bonuses, 401K payments and not to mention the taxes that each will be held responsible for if they are not made by the end of December (most employers are only responsible for paying them on a quarterly basis)
Medicare has stopped making all payments to DSI until such time as this investigation/lawsuit gets into court. B B & T has filed Writs of Garnishments against any bank account that has DSI's name on. GH has cancelled the dental and health insurance, yet the premiums are coming out of the employees paycheck. GH is stealing money from each and every employee that signed up for health care insurance.
DSI continues to issue payroll checks knowing that they may not clear because any bank account that has DSI's name will be seized by B B & T. It is just a matter of time before B B & T find any other assets GH may have.
GH is still in possession of his multi-million dollar home, vacation home, children's homes and I can almost guarantee you that he is making sure that he gets his payroll first before any of the employees get theirs.
If this Doctor actually gives him this $4 million loan, it will either be seized by B B & T because GH still owes over $6 million so he will now have to pay that loan back as well as the employees that he owes wages to.
Yes, you are all at-will employees which means that you are free to leave when you want and they (DSI) can terminate your employment when they feel it's necessary. This does not absolve DSI from paying you anything that is owed. Sales reps did sign an offer letter of employment spelling out their compensation package. This is a legal contract..not of employment but of the compensation package. YOU DO HAVE GROUNDS TO SUE!! If you choose to sue, DSI can be held responsible to pay your attorney expenses as well.
I am not wishing for anything bad to happen to anyone, but for those that are left still working please think of yourself and your family and take the necessary actions to make sure you aren't sitting out in the cold because you stood by and watched all of this. Holidays are coming and no child should have to be told "Sorry we have no money because paychecks are bouncing"
