I was copied in an email the we were using EXPIRED medical necessity forms and they told us to pass it since the test was done already . Is this illegal?????

The phrase is actually quite common. The federal government uses it just about every year around September when the annual federal budget hasn't been approved yet.
Also, some larger companies use it when they have peaks and valleys in production. But it's typically only one day a week unpaid for a short period of time.
