You are correct. See both situations are wrong. However Guidants tragedy effected a small number of patients and gdt actually cared enough to mitigate the issue. Stj has since 05 denied they have a problem and continue to sell faulty products. Can you imagine if BSC were currently selling the original Prizms w/o the changes to the header and relaunched after fda approval under the name Prizm2 and ignoring every failed device and not reporting any deaths? How would that be any different from stj selling Durata?
