$100 million class action suit







I'm guessing this "poor schlub" is one of the culprits? Actually, it would seem the last couple comments originate with the same scared author.

Well, yeah, duh..it's the same author. It's the author calling out the poster who claims to have "just read" about 40 more reps plus 7 men added to lawsuit. That statement was instantly recognized as a complete fabrication they posted for some odd reason. It was requested to provide the source of the information "read" which obviously could not be provided because it was not true. The last few comments were just a little teasing to illustrate the fact that once again, there's no evidence to back up the claim. I think it is representative of the child-like mentality of the lawsuit.

Part of her "complaint" is that they hired someone from outside the company AND another rep got a $3000 bonus for refering them!!

So, is she saying the company decided to hire some guy just because they wanted to give the other rep $3,000? Does that sound like a decision a company would make?

They hired an outside person because of familarity of the territory and great established customer relationships?? Does THAT sound like more of a reason for the company to pick that individual? Umm, yeah, I think it does. But I guess that doesn't make a good arguement for $100 million lawsuit, does it?

What continues to baffle me is why one of the women in the lawsuit is STILL working for this company...... and why one of the other women listed in the lawsuit (JB) would ever join such bullshit. I completely mis-judged her character.

The thing that disgusts me the most about this suit is the following statement that was so highlighted in the inital press releases:

"Daiichi asks its female sales reps to wine and dine male doctors"

Sound pretty tawdry, eh? Like something out of a Lifetime movie of the week where a sleezy overweight middle-aged balding guy manager tells the doe-eyed new salesgirl to "you know, sweet talk the docs, show them a good time, use your womanly charms, etc, etc". Only problem is.....it is NEVER mentioned in the actual complaint as to have actually taken place!?! Whoops! kind of an oversight there, no? I guess the headline of "Reps ask for $100 millionm dollars becuse RD doesn't say hi to them at meeting" or "Reps overpaid on maternity leave and have to pay it back now ask for $1000 for suffering" or "Rep sues for $100 million due to another rep bringing in outside hire while netting $3k finders fee" or my personal favorite "Reps forced to walk through smokey casino to get to meeting room, sue for $100 Million". My guess is the lazy interns at the law firm probably took the template from an earlier money grab lawsuit and just changes the company names. I am assuming it was interns or first year parlegals who wrote the poorly worded complaint. Either that or some law school graduate from a sparsley populated state like Wyoming or Vermont or something. The sad thing is I bet there are real acts of harassment going on out in the pharmaceutical industry with legitamate complaints. THIS just happens to not be one of them. And this money grab blunts the impact for those seeking real change for real situations....thus harming the true "victims" as they grab for thier bucks. So sad.

How an you accept a salary and then turn around 5 years later and claim it was discriminatory? Didn't you have the option to negotiate a salary? They gave you a number and you had the right to say yes or no.......NOW you change our mind? Fuck you!
 






I say Daiichi Sankyo should take a look at the sales numbers for all it's reps for the past five years and find which ones did not meet %100 to plan. They should then sue those reps to get back a few thousand dollars from each since they were obviously overpaid. That all sounds reasonable, right?

What? A company can't agree to pay a salary for 5 years and then turn around and sue because it's paid out too much? Why not?

No contract means no liability - they can fire you for nothing, you can quit for nothing. It is not possible for employer to sue non contracted employees. You must be from Europe...

Just to clarify, a good percentage of white Americans are descended from Europeans - and from your tone you must be one of them -. Second of all, Europeans do not sue for everything like Americans do. You really should save up your money and travel outside the US to gain some culture and understanding of worlds outside your home town and also learn a foreign language while you're at it. And lastly, although I abhor the litigious nature of American society, I totally agree with the current lawsuit against DSI. Just take a look at upper management - not one woman - and the few that have ever made it there were soon replaced/demoted/fired. And please don't get me started on the blatant racism at the head office and the groping of young, attractive women by so-called upstanding citizens (some of whom have political connections/positions in NJ).

Lastly, the original criticism of "being from Europe" was in reference to the early 20th century history of Europe's oppressive human rights environment where it was commonplace to have a citizen (employee) be in danger from even the perception of underperforming.
