where is my check!

Spoke to the lawyer this morning. Checks will be issued December 5th. Each representative on payroll will receive 1319.17 for every month that they have been with the company. Of course this will be taxed like normal base pay. Should be a good Christmas for those with the company for a number of years. Moving forward, the company will have a close eye on meetings, programs etc and any other activity that will cause an employee to work an excess of 40 hrs a week.

Yeah, I heard that timeframe and amount as well. Very rare you get accurate info on this site. The judgement is automatically awarded to those on payroll as well as those no longer here.

Actually the payout will be in coupons and vouchers for Novartis products like Exlax, Exforge, Exjade, Excelon, Boost, Tang, (and of course Poon flavored Tang) Now I know what you're saying...."do we have tang?" Well of course we do.

I call BS! Unless someone can give some solid evidence to this thread.

This is all bogus...unless you were in NY or California during that time frame (like 2004) you had to OPT IN to be a part of the class action...if you did not OPT IN, then you are NOT a part of the class and will not get any money...just call the lawyers and ask for yourselves like I did instead of spreading rumors on this board!

I understood that Novartis has decided to pay out to all sales reps so they don't have more OT class action suits to be filed later. If this isn't the case, can you imagine how may more they will have filed?

So I called the law firm to see if any of the above metioned was true. So far there is no news. No payout info as well. The new girl Allison (took over for Vanessa)told me that nothing has been finalized yet. Hope that helps

Spoke to the law firm as well a couple a minutes ago. Apparently they have received a few calls about this today. Well, as of 4.18 EST, the attorney had just received an update and it looks like the 1300 range per month is true. Multiply this by the number of months the employee has been with the company. Former employees will get payment as well. Specific number of months won't be disclosed as they are trying to come to agreement on both sides the timeframe.

Hope this is true. I didn't speak to the attorney just their assistant. Will they pay each rep for each month they were there? I hope this happens bc this co sucks and is so unethical!

I hope you are correct and that we will all be getting checks, especially because I have more bs admin work than ever and Novartis clearly hasn't learned it's lesson.

According to this article the ruling applies to 2500 employees employed between March 2000 and April 2007:

http://www.bloomberg.com/news/2010-...aw-requiring-overtime-appeals-court-says.html

While the article seems to point to a specific group and time period I'm hoping that since this is a class action and we are all eligible, especially since the levels of work outside the normal work day are and continue to be brutal beyond 2007 to current day. The only thing that has subsided is the amount of programs we are being forced to do. Admin work isat an all time high...most of it is just crap, that no one even looks at but we have to hand in every week. The half admin day they give once a month is crap especially when it starts out with a mandatory waste of our time webcast. I thought this time was ours to get stuff done. This company hasn't learned it's lesson, and deserves to pay out every cent it lost in this suit as well as future suits involving the same thing.

If anyone can give really specific info as to who will be getting this sell deserved settlement it would be appreciated.

My attorney spoke with the lawfirm representing OT. Everyone employed in a sales position as a rep qualifies under the federal labor laws. They cannot just pay those in the lawsuit when everyone is due OT funds based on th findings and proof presented in court and based on the job classification which got them to this point in the first place. Hopefully, everyone gets paid that was employed from the filing of this eroneous suit to the day they left, got fired, laid off, or still employed as of the date of the settlement by the court.

Do we have to contact the law firm and requestto be included? I was hired two years ago and give thematic least 50 hrs a week. What do webers to do or who do we contact?
