We're getting our overtime lawsuit payout in August!

Absolutely correct. Whoever posted the $1440 garbage is way off. The formula isn't a set number for anyone. It has to do with income, time served, state of residence, participation level in the case among over a dozen other criteria.

Not that original poster, but if you were like me then you would have seen the $1440 number quoted directly in my letter. It was absolutely shown as an estimate number - all depending on how many people opt in, etc, etc....

Sounds like we'll only have a short time to wait to see for sure. You can bet that not everyone who had the chance to respond a few months ago did, so hopefully that drives up the payout for those of us who did. Thanks, Uncle Novartis.

My letter stated hypothetically you might receive
1yr making less than 100,000=approx. $8,640 and over 100,000=approx. $4,320
So don't know where your info.is coming from

There are multiple sub-classes of employees depending on the employment date ranges and other data points including your state. You and I have likely seen our own letters and not others. Again, not that it matters, but each person who responded has their own number that is an estimate for them based on their sub-class.

Mine says - and I'm looking at it as I type this:

One year, making less than $100,000 = Approximately $1440
One year, making more than $100,000 = Approximately $720
Two years making less than $100,000 and one year making more than $100,00 = Approximately $3600.

Mine has the 1400 option quoted too.

Look ... There is no way to figure this out other than referring to your own individual letter or waiting for the settlement.

Some states are getting a lot more based on the way state employment laws are written

I won't be buying a house or boat with mine....

Maybe a new apple mac book pro though...

When I spoke to the lawfirm I got the same figuring. It's really not as hard as everyone is making it out to be. During the time frame allotted for the general case (I believe 2007-2011, I could be off) I totaled in the High 90s. $1440*4 = $5760 (the girl I spoke with agreed with this number but maybe I'll luck out and she is Math inept and there will be a Zero after that 5. :)

Cali & NY = appx 7K per year under 100K x 7 years max
Thank you NVS for underpaying me for 7 years
The red 2013 Viper you see with the plate OTPAYOFF
roaming the streets of southern cali will be ;)

It all depends on your state for both duration and amount.

I plan on getting that LED 3-D tv I've had my eyes on for a while. I don't expect to get much more than that. (Ohio, <100k, 12 years)

Just can't believe with salary and bonus after 7 yrs you were not making over 100K.
Every time you get leveled you would get a 8-10% increase. You people must be really pitiful.

You could be the best rep at Novartis but if you're Manager has it in for you, you get 3-5% leveling bumpm with EOY bumps anywhere from 1%-3.5%. Now that's pitiful!

Regardless of the amount, do we pay state/fed income taxes up front or simply deal with that come tax time? Do we pay FICA/Medicare/Social Security/Etc.??

Thanks ....

Called Rust Consulting and state and federal taxes will be withheld. Don't know about other. Also was told that checks are going out late July and everyone should receive them no later than August 15th.

As stated in the letter you receive, the dates for employment (in order to be included in the lawsuit) were Jan 25, 2009 through Jan 25, 2012

That may be true for some letters (including mine), but states have different statutes of limitations on collecting back pay. Some are 3 years, some are longer. That will determine your months of service figure that is used to multiply times the monthly $ figure.

Here is accurate information:

Checks will be cut and sent out Monday.

You should have check by Friday, August 3rd

If by some chance you don't receive by August 25th, you are to call Rust Consulting.

Finally, every state is getting a different payout and length of payout. You geniuses need to stop haggling over free money.

Look Dummy's, I was deposed in 2007 for this case...obviously a while before 2009. If the case was from 2007-2009 or more recently as one posted said they wouldn't have even contacted me. The first time I was contacted by SWH about this case was in 2006 so get your facts straight and quit trying to sound like you know your a-- from a hole in the ground.

Taken from the court documents:
I. BACKGROUND

Novartis researches, manufactures, markets, and sells pharmaceuticals. The plaintiffs are some 2,500 persons who were employed by Novartis at various times between March 23, 2000, and April 7, 2007, as sales representatives (“Reps”) in California or New York, and who are parties to class actions in the United States District Courts for the Central District of California or the Southern District of New York, respectively, along with Reps employed by Novartis in other states during that period who have opted to join these actions. The actions were consolidated in the Southern District of New York by the Judicial Pan el on Multi-district Litigation for coordinated pretrial proceedings pursuant to 28 U.S.C. § 1407. Plaintiffs alleged principally that under the FLSA and state law, they were entitled to overtime pay at the rate of one and one-half times their normal compensation for time worked in excess of 40 hours per week. The following facts are not in dispute.
