NEW THREAD - Check Arrival Updates

On the west coast and received my check yesterday. My backpay comes out to 198 per month... Not sure if they got my employment dates wrong or if other people miscalculated the 220 per month they claimed to receive. Also, compensatory award is not split by both riders, it is stated as a single award.

Got my check in NJ today!!!Yeah. Backpay was taxed. Compensatory(medical) was not. It is one single award and is broken down on how they paid it out on the top right hand corner.
1.Gross award 2.Backpay 3.Compensatory Award 4.Total Taxes Withheld from Backpay 5.Net Backpay Award 6.Net Award(Grand Total). Compensatory is for the medical. This is non-taxable.

Enjoy!!! Couldn't have come at a better time...

It roughly comes out to $201.62 per month x how many months during the timeframe of 7/15/02 to 7/15/10 you were employed. Remember, its also based on what your salary was at that time. Our salaries, I'm sure, all varied to some degree.

Hope that helpful. Looks like most of NJ got theirs today. NY should be arriving the same or close to... They were ALL mailed on the 23rd.

Compensatory Damages Not Taxable According to Federal Appellate CourtPosted by Tiffany Sanders J.D. | Posted in Personal Injury Legislation Watch Until 1996, the Internal Revenue Code excluded compensatory damages–those damages included to “make whole” a plaintiff or restore a person to their pre-injury status–from the definition of “income” for tax purposes. However, ten years ago the statute was revised to exclude only compensatory damages related to physical illness or injury.
In a tort case decided today, the United States Court of Appeals for the District of Columbia held that inclusion of non-physical compensatory damages in the definition of “income” for tax purposes violates the 16th amendment.
Relying on the definition of income as a “gain”, the appellate court held that damages intended to restore a person to pre-injury status could not be considered income, even where the losses were not physical or economic.
The ruling may be appealed, but if it stands it will mean that compensatory damages in personal injury cases are no longer taxable, even if they are awarded for intangible injuries like emotional distress and loss of reputation.

Just an FYI...as far as taxing on Compensatory Damages. Just wanted to add that in.
