March 12 (Reuters) - Italian medical device maker Sorin Group (SORN.MI) said it reached a preliminary agreement with the U.S. Department of Justice related to an investigation into the sales and marketing practices of its unit Ela Medical Inc and its former sales representatives.

Sorin expects to successfully complete negotiations required for a $10 million settlement, to be paid out in the third quarter.

The company, which makes devices to treat cardiac rhythm disorders, said the settlement will not impact its 2010 results and backed its 2010 net profit outlook of 33 million Euro ($45.4 million) to 37 million Euro ($50.9 million).

Sorin has already booked a provision for 7.2 million Euro ($9.9 million) for this event in its 2009 financial statements, the Milan-based company said.

Sorin said as part of the settlement no charges will be brought against the company, its employees or management and the settlement itself was not an admission of wrongdoing.

Remember how much money MDT and BSC collectively paid for all their recalls? Sorin could pay 10millions daily and STILL not ever reach the enormous amounts of money your company has paid for years !!! So who's the bad guy now? 1. What exactly did Biotronik do wrong? A rep did checks in the office - that happens about 15,000 times across the country every day. I'd love to stop doing checks - but I'd lose all of my business - and so would everyone else. Ed Tague may not be the sharpest rep, but he's doing the same thing every other sales rep in the industry does every day.

Do you think Medtronic reps wouldn't tell a doctor, "Sure, we can do the Bio/St Jude/Boston checks - if you give us their changeouts."

2. The data was "lost". Bio is the only company that has a hard drive for follow-ups on their programmer. No other company even offers it. Bio would be better off getting rid of the hard drive - its above what everybody offers. Anyway, the hard drive data is irrelevant - all that comes up is stored follow-ups, statistics, parameters, and EGM's. A plaintiff's lawyer doesn't have any use knowing a patient's threshold is 0.8 volts at 0.5 ms. It's not like there's any real medical data on the programmer. There's no medication data, patient history, etc., pn there.

3. Biotronik was added to the lawsuit because of deep pockets. Have you ever seen a physician malpractice lawsuit? Every physician who ever touched the patient is added - even if they had nothing to do with whatever happened to the patient.

4. While we're talking about how bad Biotronik is, whatever happened to those 22 patients who died with their St Jude Riata lead? Oh, I forgot, this is a much juicier story than some old person dying because a company makes a shitty product. I overheard a St Jude rep on Friday telling a doc - in a joking manner - that now the doc will make more money of the Riata lead because he has to flouro it regularly. Ha ha - fucking hilarious.

Not every rep does clinics. In fact in the Midwest most doctors have their own clinic people. What will be interesting is to find out if in fact Biotronik relocated Klonis to New Mexico.
