BMS and CSO Separation

Our folks in accounting don't know how to run MS Excel? Send the spread sheet to me. I'll have everyone paid by the end of the weekend. Nearly all of us have a BMS counterpart that got paid out 2 1/2 months ago. We get paid the exact same amount that they do.

This might be the biggest smoke screen I've ever seen to screw people out of bonus money.

It is abosute insanity that it is the first week in August and we haven't been paid a dollar of bonus for the 2011 sales year. If I sucked at my job as badly as incentive comp sucks at theirs- I'd have been fired a long time ago.

NO accountablilty= No quality.

From now on- I'm just collecting signatures all day. I'm not selling a God damn thing until I start getting bonus. My BMS counterpart is about to get his Q2 bonus and I still haven't seen Q1.

Why would I sell anything?

There has got to be some kind of legal recourse here... So ridiculous! Essentially we are allowing this company to have an interest free loan on OUR money. Ventiv could care less about it's people, it's all about profits, always has been and always will be. But, there has to be a way for employees to get what is owed to them... Isn't there a clause in the employee handbook that states the time of payout?? Why aren't more people angry about this bullshit?

NO LEGAL RECOURSE we are fucking temps. We are owed nothing. When we signed up for a shitty temp. job that is what we get. A shitty TEMPORARY job.

Now the Ventiv leadership is blaming BMS for the delay in payout. What a bunch of idiots.

News flash: Don't ever blame your client. Making them out to be the bad guy won't help you in the next contract negotiations.

I was told today by my bms manager that we should be getting Q1 bonus in a week or two but it will not be on tomorrows pay check. Its simply amazing that I had to go to BMS to find out what was going on because my RTAM had no clue.....smh

First of all, regarding Q1 bonus, does anyone buy that BMS JUST gave inVentiv the calls per day data, etc? When they are constantly running reports throughout the quarter on that stuff, not to mention BMS reps were paid well over a month ago and no problem figuring all THEIR data. This is so wrong.

Secondly, most believe this contract is done Sept. 30th, at least for most... What are the rumors or thoughts on when that will officially be announced? Wondering if we'll be in the field all of September or if they'll announce it early. Shouldn't we get 30 days notice?

Also, at this point, they're going to owe us 3 bonuses... HOW will this play out?!

They dont have to give us any notice. They can tell us the week before if they choose. Its just one of the many shitty parts of a contract. I would hope they pay us out all three bonuses. We would just a check after the contract ended for Q2 and Q3 but they dont HAVE to pay it out.

How is it they don't HAVE to pay it out?? I don't believe that. Obviously this is an unethical and unprofessional company, but not paying us those bonuses at all would be illegal I think. If we leave on our own accord, I know the IC plan states they don't have to pay us, but if they end the contract they do.

I am a good rep and I have worked hard to drive sales, but why should I anymore??? This is beyond ridiculous. Do the BMS DMs get this AT ALL? No. You just have to put on the happy face and pretend everything's terrific.

Look, I agree with you as well. They should pay us our full bonus. I, however, have worked contract before with another cso and was told that if the contract ends.....they technically dont have to pay us anything since we are not employed. Its effed up I know but we all signed on to this.

It seems in today's world the only way to get pharma companies to do anyting is to file a lawsuit. We wouldn't have a chance of winning a case concerning the bonus payout because Inventiv had their lawyers cover them in our hiring agreements. Essentially, they aren't required to pay us bonus money. It would be the moral and ethical thing to do but... Not the most profitable.

So, we could do what all of the other pharma reps are doing that have been fucked-over by pharma companies... sue them for over time pay. All but 1 case has been won by the reps. Its kinda like convicting Capone for tax evasion when he murdered hundreds of people. They won't go down for being unethical, lying bastards but... they'll still go down.

I just find that hard to believe. We have all learned that this "organization" has no class or ethics and is likely doing all that they can to hold back our bonuses because if WE choose to leave, then they don't have to pay us... BUT, if the contract simply ends as a whole, I am 99.0% sure they still owe us the bonus that WE EARNED during the time that we were here. I'd have to look at the document, but I am pretty certain that is the case.

Granted, I suppose they could choose to roll the dice and attempt something like that in the hopes that no one will sue them, but is it worth it? What does that do to their reputation in getting other contracts?

If you want committed reps that are here to SELL, this is NOT the way to treat them!!! BMS and future clients... take note!!

Most state employment laws protect the employee in situations like this. Look up your GL's for your state and see what's said. Typically, they will pay you through the last FULL QUARTER you worked.

Good luck.

Does anyone know how we get this started? We're all getting screwed and shown the door in the next month or 2.
