Ah age discrimination...Quest wrote the play book.

There is a difference between age and functional obsolescence. In most examples related to employment, the maturity and experience of older employees is considered a valuable asset. However, when the experience the employee possesses is an impediment, they become a liability. Change and progress are inevitable. Quest Diagnostics, as always, is on the forefront, well prepared with a solid plan. The unprepared who are concerned only with who is to blame for their fate will soon find themselves left behind and all alone. Hope this helps.

It’s unfortunate that the distinction I made between the accusation of age discrimination at Quest Diagnostics and the necessary process that successful businesses must undergo to implement progress was lost on you. I thought my suggestion to be prepared was well founded. If you can explain, I am curious why you believe I am a miserable person, who has a miserable life, and an asshole who is never funny and a dick. I can’t help but to worry about what must be going on in your life that would compel you to post these things about someone you have never met on a Friday morning between Christmas and New Years. At the risk of setting you off further, it may be time for some self reflection. Hope this helps.

Instead, laboratory is defined as "a facility for the biological, microbiological, serological, chemical, immuno-hematological, hematological, biophysical, cytological, pathological, or other examination of materials derived from the human body for the purpose of providing information for the diagnosis, prevention, or treatment of any disease or impairment of, or the assessment of the health of, human beings." Therefore, enforcement action under EKRA could potentially reach laboratories outside the scope of substance abuse treatment. Additionally, EKRA seems to implicate engagement of sales and marketing representatives, as such individuals are compensated for inducing referrals.

It doesn’t really matter as we all know our lab business is just as corrupt!!! A few bad apples spoil the bunch! This will hold true to all Lab. Our commission is going away period, end of story.

You really believe that the language of the law regarding sales compensation was written with the intent to curb unnecessary ordering, aimed exclusively at toxicology and nothing else? And you believe that it was just put together haphazardly so as to accidentally include the overwhelming majority of medical testing where inappropriate influence actually makes a difference. And that they are working to fix that. It’s truly amazing what you can get someone to believe, when they are so desperate for it to be true. This is great news for Quest and Labcorp. They are taking back control of their business. No more need for non compete contracts, worries about reps shifting business to smaller labs or the liability of stark violations. The reps influence is gone now. As will be any rep formerly involved in sales. What you are witnessing now is the grace period prior to strict implementation. In the coming days you will hear a lot of “it was just an oversight. It wasn’t meant for you. It will all work out, just hang in there.” All the while they will be working on the transition behind your back. Hope this helps.
 






couldn’t agree more the post above! Stop being in denial you guys. It’s a new law and regardless what you’re hearing especially from our employers, sales reps in lab will no longer get compensated in forms of commission or bonuses.
 






We all know congress is a mess. Worrying about this makes little sense. If corporations are people, my friend, then it stands to reason that they can pay whomever they want whatever they want to advocate for them.

Mature and experienced employees are equally valued by the business community at large and by Quest Diagnostics. After all, who seeks out a young attorney or physician who is fresh out of school, or a manager or med tech that never held a job before. But experience can be equally problematic under certain circumstances. What is the value of experience when it is outdated or when new laws prohibit the use of the skills that were acquired? When is the last time that you hired, or even thought about calling a travel agent? And unlike commission based reference lab sales professionals, travel agents at least are still legally allowed to be compensated for their services. Lastly, anyone hoping this new law was just a mistake or that Quest and Labcorp will be working to overturn it are delusional. This was a planned out welcome change for the industry and the legislation was crafted with the cooperation and assistance of our employer. Hope this helps.
