What happened in St. Louis?

Exactech baby!! Jeff Binder has wanted those guys for a while now. They’ll have a big enough area to work around their non compete and 2 years will fly by!

2 year non compete? What shitty state would let that hold up in court? Plenty of ZB reps who still refuse to sign a non compete these days, they have lots of business and ZB isn’t gonna risk losing it.
 






Sorry to burst the Exactech bubble but the worst kept secret in Orthopaedics says it’s a done deal with Stryker. Pretty ballsy to just flat out violate a non compete but it’s pretty much done! ZB is in trouble in that market
 


















Most non compete contracts are nothing more than a tool to keep low / middle income people in check. A non compete is unenforceable if it is too broad ie. "You can't work in the medical field for 2 years in the U.S. or internationally." or signed under direst such as your boss coming to you after you worked for the company and requiring you to sign it as a requirement remaining employed. What they are counting on is people can't afford to fight it and not work while the legal battles come to a end. Lawyers and companies realize most employees will take the path of least resistance.

Can they fire you or refuse to hire you for not signing them? Yes. If you live in a right to work state they can fire you because it's Tuesday as long as they can prove it was not done due to Race, Creed, Religion or Sexual orientation.

-Old ZB distributors that were fired and obviously soliciting their old customer?
-ZB for firing them in the first place?
-Current ZB rep for shopping his surgeon around?

Unless you’re a complete idiot, everyone knows what you can and cannot do around a non compete/non solicitation agreement. Should be upset with the idiot who thought posting proof was a good idea. Lawyer up and get ready!
