Everyone knows TG is looking to go to Brooklyn and take a couple of guys with him. No secret there. The questions remain how will you get around the non compete, no independent contractors as they are illegal and will the business follow without the favors for the docs?Now that is funny!. The guys leaving Sunrise was the final nail in the coffin for this place. What genius put that contract together? Looking for something half that good and would take it in a second!

Non compete unenforceable.?? I think you may want to re think that. Baker will tie you up for at least a year. Yaffe will not get involved and neither will Shiel and you will be without commission for a year. Yaffe is an opportunist and if you can offer him nothing other than a lawsuit against baker he will not go with TG. This is going to be interesting.LabCorp to take Yaffe acct with no compensation to TG! And laughing already about it! Move em to the navy yard now and show them who is boss! And the noncompete is completely unenforceable by the way.

If a 1099 sales rep (independent contractor) generates Medicare/ Medicaid business for the supplier, the provider CAN NOT pay the sales rep on a commission (or other type of production) basis. Doing so violates the Medicare anti-kickback statute.
You would think the HDL/Bluewave DOJ case would give the industry a reminder about commission based incentives and the Stark Anti Kickback, but presumably some folks never learn-or just play the game until it ends suddenly with a filing in a US District Court.
