"Illegal activity at LabCorp"

I beg to differ...telling an account than you will accept ALL of their insurance plans; even the ones you DON'T have a contract with, and then "eating" the costs for the plans you can't bill, is illegal. It's inducement, and I believe it's a STARK violation. labCorp does this all the time, in fact, they have been reported and investigated/fined for it.
 






There are a lot of things that LabScam does that are illegal. They have couriers pouring off specimens in some areas. They have non techs running and reporting out results- this happens in the Tampa lab all of the time. They let specimens sit in the trunk over the weekend and know that the temperature has damaged the specimens but stick them through to avoid being fired and get away with resulting out patients results. The list is endless. When's the last time Ovasure was being promoted? I saw a rep just LAST WEEK promoting this test.

Didn't the FDA send them a warning letter? I guess Dave will have to find more corupt attorneys to cover his continued scams!

It would be a violation of the anti-kickback statute, but the Stark law is regarding physicians who refer Medicaid Medicare patients to an entity for which they have a financial relationship.

The compliance officers at LabCorp are a little hesitant to use the old agreements that state they will write off the out-of-network revenue as long as a physician has no financial incentive to do so.

What will possibly bring this company down, and maybe the industry - or at least knock it down as what happened during the 90s LabScam - is pricing. It's happening now in California, and it's going to get ugly. A simple audit will expose the non-compliance in every division. All divisions have, at one point or another, priced tests under cost, below fair market value, below Medicare expect and in some states (like California), below Medicaid costs. It very difficult to police in client-bill markets or even 3rd party markets' IPAs and smaller m/c entities. In California, their Medicaid program has a stipulation that make it illegal to price other vendors (physicians, hospitals, labs, MCOs…) testing below what they charge Medicaid. And, since the CA’s Medicaid Hemogram is reimbursed over $8.00 … then we have a major problem. Come on all you sales reps in client bill markets. Even a Complete CBC with Diff is prices from $2.50-$4.00.

Pricing is the next industry’s Ferritin.

Aw this happens all of the time in the MidWest Division. Salespeople in Arkansas, Mississippi,
Tennessee and Missouri are instructed by their RMBD to do so. Doesn't matter what you say, just so long as you bring in the business. Motto is "Stretch the truth for Quota. Get the Business and we'll deal with it later", (SH).

Not a single lab has ever been charged or convicted of this "illegal activity". When other laws allow "Market pricing", and client bill pricing (which LCA has been sued before for misusing in NC); it is difficult to enforce 1 law while several other support it.
 






Dude, you're a fool...you obviously haven't been in the lab industry long...LabCorp has been investigated so many times for various violations since 1995...they have paid fines and settled multiple times. They have also received many letters to "cease and desist" marketing practices that were in violation of many rules/regs. LabCorp has a reputation for these practices, and is known as one of the dirtiest players out there. Your service blows, so you do what you have to to compete. Quality labs don't need to operate like this. They earn their customers and keep them.

Yes, there are several lawsuits for this in Florida.

I saw a rep promoting it just two weeks ago, a full several months after the fda warning. whats up with that? Either there too arogant to listen or comunication didn't make it out to everyone and there to arogant to care about the consequences. Really, you should work in retail, or you are a scum bag reading sites in hopes that you can find something that someone will respond on, however you, most likely a lawyer, that cannot pay the note on your home, and has quit er chasing and found this site on a fluke----- you have figuredured it out!!!!! You can't get a big medical claim by surfing the internet, you actually have to have valid facts, and have been a part of them - IDIOT!!!!!. Invalid results that caused death and miscontuct by the providing lab............. However you continue to bring up the one rep that continues to market a test that LCA clearly has a NOT ORDERABLE status on???? Yes LCA recieved a warning letter from the FDA, not un-common, how about all of the articles that clearly indicate that the pharma industry was given prime goverment contracts on new meds, primarily schizophrenia medications where the FDA admitted that they do not have the staff review every drug put on the market regarless of side affects.

Not to mention the leasing Stark issues. If the FMV analysis shows a physician is being paid over FMV, get a new broker to give you a new FMV, & tell him what numbers you want. And don't complain to management about this, because you will be told you are not a team player.
