Hours and wages lawsuit settled for $99 million













Heres how the payout works. If you were over $100,000 in salary you will get $1500. Any salary less than $100k you will get $750. This is a fact that I confirmed with the law group handling the case.

So what you are saying is the lawyers will get $98 million and we will split $1 million....you are brilliant.

I do not live in CA, or NY, I live in a neighboring state (for which one of the states mentioned was part of my territory) and worked at least one (1) day in that state, as explained in the subclasses of inclusion. I, too do not remember receiving or acting on any legal notice for opting in/out, etc. so my concnerns were around timely opting in. Doesn't actually say you had to have LIVED in these states, just that you worked at least 1 day in them. I would only expect that when it comes down to it, it will be based on the extent of time spent between the 2002-2007 time affected.

I called the US dept of labor, who directed me to the courthouse in NY where the decision was made. I spoke directly with Judge Crotty's assistant, who provided me with the contact information for the legal asst at stanford wittels and heisler handling the case. I got called back within 20 minutes. She explained to me that the week of 2-24 that notices will be sent out in the mail again to everyone. The way the lawsuit is set up, is that most people will have some way of being able to participate. I would contact the law office and make sure your information is up to date. They will ask for your address and email. If by the 2nd week of March you have not received anything, you can call their office to follow up.

Since the state I live in doesn't border CA and NY am I still opted in or am I out? Also, I don't recall getting any paperwork yet! When should I expect those papers to come in? If you weren't in CA or NY and didn't opt-in according to the initial pleadings you would get nothing.

From what has been posted as "quotes" from the law firm however it appears as though the settlement has been structured in such a way so that everyone who worked during that time frame will received a settlement award based on length of service. However that is all layman's interpretation. If you receive nothing about the settlement by mid-March in the mail then you should call the law firm at the number found throughout this thread immediately.

Whatever you may get though should be fully taxable under federal and state laws plus you may owe Social Security on it as well.

My best guess and it is only a guess is that the numbers, legal and court fees look as though most everyone should get a small four figure check after taxes etc. if you worked the entire time. I would not spend a dime until you have the check in hand and made sure all the taxes are first paid on whatever you might get.

Ok... Someone help me.

I live in Vermont but I have an uncle who lives in NY and an ex wife who lives in CA. I hosted a dinner program once in RI and 2 doctors that attended were from Oregon. The waiter at the dinner lives in New Hampshire.

My question is how much will the waiters brother get from this lawsuit if he lives in West Virginia?
