Do NOT go to anyone in house, including the ohbudsman! I did and totally regret it. She ripped me apart, was never looking at my side! I didn't even want to deal with her, she was that awful. Anyway, learned the hard way and now as I look back I believe I had quite a case and plan to start looking for a lawyer. Write as much down as you can now! I have several notebooks(great therapy)!
BTW: you try and throw a manager under the bus and you will be history. Hope you have very, very deep pocket for any litigation.

One was actually hit across the face by her manager with an object and insulted, screamed at and abused in public. She filed a complaint with the company and all of the above including getting a lawyer. Guess what? She was history pretty damn quick - out due to poor performance. Lawyers do not do this for free you know and her case dragged on and on and on and on until she had no more money in her savings. Still, she really believed and so did her attorney that she had a good case. She took out a loan. Two years went by and the "boss" was finally "downsized". The company restructured and my friend ran out of money. Now, that is how it works in the real world. The EEOC's investigation was closed (no idea why you think OSHA would give a shit). The company is still in business and my friend is still out of work and most likely blacklisted because it really is a very small world.

Why would you report that to the company and not police? Through the police, it's the state vs XXXXXXX. A civil attorney does not take money up front. They will get 25-33% of the settlement after expenses. If the person went to the police, there would have been a report made. That is the beginning of the paper trail. The state would handle the criminal portion and a private attorney would handle the civil part of things. Without the initial police report it's a uphill battle.
It's like if you get into a car accident and the other driver states he would like to handle it without the insurance company getting involved. You still need the police report made at the time of the accident. It does not mean you will hand it to the insurance company, you need it for protection. If the person does not pay you for the damages, you must go to the police department and get a self written police report and it does not carry much weight. It becomes an issue of he said, she said.
Also you can tape a conversation with your manager and that would be 100% allowed in civil law. 50-50 chance for criminal (depend on the judge). Phone conversations are a different story.

The days of winning some big million dollar wrongful whatever suit and signing away a percentage are long gone. No attorney has that kind of time or free resources especially for such an unlikely case. Only wrongful death or imprisonment get this kind of "credit" granted. I have a great deal of experience in matters such as these. You absolutely cannot tape a conversation in many states without both parties being aware of the recording. To do so, is a federal offense. Civil attorneys do not work hourly, the ones that do are scam artists. Call any respectable firm, even cheesy team law. There is more money by taking 25-33% of the payout than hourly. If there is no case they just will not take it. The government can not tap your phones or other communications without consent from a judge because they are considered third party representation. If the person recording the conversation is part of the coversation it is not illegal. If the person talking to you gives the person who is recording permission to record the conversation then it is also not illegal. But if the coversation is recorded by a third party without anyone present's consent, then is it is illegal as long it is not in a public place. Hope this makes sense?
Same for emails also. I cannot hack into your account and expect it to be legal. If you email me and it states something illegal, then it can be used as evidence within a criminal or civil case when turned over to the civil attorney and police.

I find it hard to believe that any bad employee, at any level, would ever be protected. The company would have to looking to implode. To keep people in positions where they are either incompetent or harmful by breaking policy or by their behavior is ridiculous. Why would good employees who rightfully stand up or themselves ever be punished?
