Another Lawsuit vs. Eisai

<

No one in the HO is concerned about these types of lawsuits. They are concerend about the issues involving the Medicare Part B Drug and Average Sales Price (ASP). Between channel stuffing and ASP, there will be plenty of problems!

Plaintiff will get some good stuff thru depositions & discovery.
Too much to hide when land mines all over.

You reap what you sow Eisai. Hope you guys get hit up big time by jury. Would love
to see huge punitive award.

You are missing the point. The moment a company starts receiving this type of letters, they are prelude to something bigger. It doesn’t take a rocket scientist by reading this board that this place is leaking badly. Eisai is in trouble. OB, KK, LC, and others are finished. It is just a matter of time.

Probably Aloxi initially, but Eisia changed the way MGI was calculating ASP, so Eisai should be OK.

Jerk Off,..when a company acquires another company they acquire all previous risk…meaning if MGI did something illegal 10 years ago, Eisai would be on the line for it at a corporate level, and the previous MGI employees would be on the line individually, if the GOV chose to pursue individuals criminally in the case of fraud, embezzlement, etc.. Eisai would not be fine. Here is an example. Pfizer is on the line for all of Wyeth’s pending lawsuits over hormone replacement therapy.

Seriously we must have the most “state schoolers” of any drug company…

He should have been fired when they paid 4 billion for MGI
LOL
He paid 4 billion for a total of $400 million in revenues..after all costs, about $200 million goes to bottom line.
Let see so in 20 years the company will break even.
Bottom line the company is getting their butts sued in federal court for off label promotion of ontak by some guy in Florida.
Cant wait for the media to get their hands on this one

Yeah I’m sure the media is going to be all over a $60M a year, seldom used, cancer drug from a 3rd rate Japanese company…just like any of these cases Pfizer etc, you’ll never hear about them unless they are settled for millions upon millions of dollars.

Fuck off fuck face. Want to meet up and fight about it tough guy?

J&J settles off-label Topamax claims for $81M
Off Label Marketing Costs Jazz Pharmaceuticals $20 Million
Pharmacia Subsidiaries Reach $34.7 Million Settlement with DOJ
•a settlement by Medicis Pharmaceutical Corp. in 2007 for US $9.8 million for sales personnel pushing the use of Loprox, a skin topical preparation, for use on children under 10 years old, including for diaper rashes, even though this was not an approved indication.

Doesnt matter how big/small drug revenues are, the Feds are headhunting right now, 1 small drug like Ontak could lead to an investigation into an even larger fish like aricept, acihphex, aloxi, etc...

Hahahaha, I have to agree with you there. It is hard to even find people from GOOD state schools here, especially managers. No wonder the managers have no idea how to "lead or inspire", adn the company is sinking.

Yes but until there is a blockbuster settlement the press will not be interested. Also all of the companies that get hit for this merely pay the settlement, and keep chugging along. The press will bury it in the middle of the business section and no one will care. It’s not like Eisai is heavily invested in by Americans or American funds/banks. It is not of major interest.
