Stryker Claims Zimmer Stole Employees

Law360, New York (April 1, 2011) -- Medical technology company Stryker Corp. hit rival Zimmer Inc. on Friday with a trade secrets and breach of contract suit in New Jersey, alleging that Zimmer poached entire segments of Stryker's sales force.

The suit, filed in the U.S. District Court for the District of New Jersey, alleges that Stryker and its subsidiary Howmedica Osteonics Corp. stands to lose millions of dollars in sales as a result of Zimmer's recruitment of 14 of its employees.

The ex-employees signed contractual agreements not to solicit Stryker employees or customers after they stopped working for the company, and not to disclose the company's confidential information, according to the suit.

Ten ex-Stryker employees who joined Zimmer are also named as defendants in the suit, including Paul Graveline, who was Stryker's vice president of sales for 13 years until resigning in June to become Zimmer's chief operating officer.

Over the last six months, Zimmer has been "willfully and maliciously targeting" Stryker employees as part of a scheme to establish a spine-related products division without expending any effort to build it, the suit claims.

In addition to causing Stryker significant monetary losses, the employees hired by Zimmer will be able to exploit Stryker's confidential and proprietary information to unfairly compete, the suit claims.

The information can be used to target Stryker customers and give Zimmer information on how to improve its products and customer relationships, according to the suit.

The suit claims that Zimmer has "poured millions of dollars" into the scheme to poach Stryker's sales force and create a spinal products business.

"Zimmer devised a scheme to create an instantly successful spine organization, with all of the hard-earned customer relationships and highly trained sales management and employees enjoyed by Stryker Spine," the suit says.

The suit specifically alleges that the former Stryker employees breached their employment contracts and fiduciary duties to the company. It also accuses Zimmer of actual or threatened misappropriation of trade secrets, tortious interference with contracts and prospective economic advantage, corporate raiding, and unfair competition.

A representative for Zimmer could not immediately be reached for comment on the suit.

David M. Monachino, James S. Yu, Michael D. Wexler, Molly M. Joyce and Jeffrey P. Swatzell of Seyfarth Shaw LLP filed the suit on behalf of Howmedica.

Counsel for Zimmer is not yet listed in the court docket.

The case is Howmedica Osteonics Corp. v. Zimmer Inc. et al., case number 2:11-cv-01857, in the U.S. District Court for the District of New Jersey.
 


















Wow. Recently interviewed for Zimmer Spine. Everyone was right on the money. This "team" really is a joke. I was asked to come in for a 2nd interview... I told the recruiter I pass... Immediately. Hiring manager (Tom Fallon) is likely the last person I would ever work for. The guy was terrible at interviewing, pretentious (not sure why, he works for friggin ZIMMER!?!). For being a spinal screw implant division he acted like the interview was for NASA ENGINEERING. Looking at him I could only assume that he got picked on through grade school and is taking his revenge, lol. Pretty sad guy, definitely not management material and very unskilled in telationship-building... Maybe that's why he got thrown to Zimmer from Stryker.

Anyway, turned it down for a position with J&J device sales. So glad I got out of that r***** spine screw/implant gig when I had the chance. Thanks, Tom Fallon, for portraying the "Horrible Bosses" quality upfront. Hope you didn't get too many wedgies in high school! LOL

Future advice, try looking people in the EYE when interviewing them, genius.
 



Zimmer spine actually has some great products that are better than major competition. It's just sad how leadership is not doing the proper things to get themselves in top 3. They will be there in the coming years. Honestly, I see the best spine product companies as Medtronic, Synthes/Depuy, and Zimmer. Stryker's products are just your basic run of the mill plates and screws and Biomet's were probably good about 20 years ago. There are many innovative small companies that have one or two great products but that's it, they can't truly satisfy a spine surgeons needs for every case. Watch out for Zimmer because they are a up and comer but really should have already been a major player.
 



Very true... Just seems like Zimmer management is severely weak. I agree with the Anonymous guy a couple posts back. I've met the Weatern Regional Branch Managers a couple months back... A bunch of knuckleheads. Kind of a "my sh!$& don't stink" group. Given that they are working for an "emerging market" type of division for the company, these clowns should be QUITE a bit more humble and focus on growing the sales "TEAM" and enticing good reps to join.
 



I recently worked for Zimmer Spine, and yes their portfolio of products is actually very good. The problem is management and absolutely no contacts or viable connections within the FDA. The Dynesys technology has proven exceptionally good in fusion indications - but is a motion-preservation construct, and if granted a non-fusion indication by the FDA - That product alone would be a home run.........Medtronic got their motion preservation device approved in one year with only a sheep study - It subsequently failed.....The Dynesys system has years of data and proven outcomes and has been repeatedly rejected by the FDA for non-fusion
 



Are you serious? I agree that management is terrible at ZS, but so are their products. Have a lot of holes in the bag and no innovative products, unless you consider Dynesys innovative, and that ship has sailed a long time ago. The sales reps at ZS have been dying for corp to make a decent acquisition, unlike the Abbott one. My bet is that Zimmer corp gets read of this crappy division within the next year.
 






I JUST met Tom Fallon. Words of advice... I met him as a COLLLEAGUE, I work with Zimmer. He had some issue looking me in the eye when speaking to me. Kept looking at the ceiling and towards the door, never in my eyes. How is this guy a manager of people? I may re-think my division. Bad boss, really ACTS like a retarded Stryker rep. OOOOPS, he is. Well, a Stryker manager... Someone who can't sell and had to take a manager role.

Interesting posts. I remember when we (Syryker) let Tom go. He had some good ideas, and, well... That's all I'll say. Btw, I was not his boss... He was kind of known as a primadonna in the "family". Funny that he ended up there in a 2nd rate spine div. We all knew it was a matter of time. Sorry brother.
