Merck Gets Subpoena Related to Drug Marketing

The Justice Department has issued a subpoena to Merck & Co. as part of a criminal investigation into the marketing of certain drugs, Merck said Monday.

The drugs are Temodar, which treats brain tumors; hepatitis C treatment PegIntron; and Intron A, which treats certain cancers and other conditions.

The Justice Department is seeking information about the marketing and selling activities for these drugs from 2004 to the present, Merck said. During most of that period, the drugs were marketed by Schering-Plough, which Merck acquired in 2009.

Merck of Whitehouse Station, N.J., disclosed the subpoena in a filing with the Securities and Exchange Commission Monday, saying it was part of a "federal health-care investigation under criminal statutes."

Merck spokesman Ron Rogers said the company is cooperating with the probe, but couldn't provide further comment.

Temodar sales totaled $481 million for the first six months of 2011, while PegIntron generated $319 million and Intron A had $96 million in sales.

The Justice Department has previously investigated Merck and other major drug makers for various health-care fraud allegations in recent years, including the alleged promotion of certain drugs for unauthorized uses.

Last year, Merck set aside $950 million for the impending settlement of a federal probe of Merck's research, marketing and selling activities surrounding the once-popular Vioxx pain drug, which Merck withdrew from the market in 2004 after it was linked to higher risk of heart attacks and strokes. A final settlement hasn't yet been publicly announced.

Separately, Merck disclosed Monday that the Justice Department and Environmental Protection Agency are pursuing civil penalties of more than $2 million against Merck for alleged violations of environmental regulations at Merck's West Point, Pa., and Riverside, Pa., facilities. The action results from the EPA's inspection of these sites in 2006, and Merck's subsequent submission of information to the EPA.

Merck said it believes it has meritorious defenses against the allegations.

Also, Merck said it agreed to pay a $260,000 fine and sign a consent decree to resolve alleged environmental violations at its Las Piedras, Puerto Rico, facility, in connection with an EPA inspection in 2008. The allegations were related to the site's leak-detection and repair program.

1 to "post" that changing the light bulb is a good idea
9 others to agree to changing said light bulb
1 person to fill out a form to start the light bulb changing process
1 person to approve said light bulb change

10 to meet again to discuss how wonderful the new light bulb is and how Merck is at the forefront of lighting needs
1 to suggest ways that the light bulb might be changed better in the future
1 to forward the email to their bosses to make sure they get recognized for their contribution to changing the light bulb

I've never seen a company have 15 conf. calls before a meeting to talk about a meeting.
I've never seen a company have make believe positions like MGAM, what the hell do they do again? My MGAM licks the table when we meet with him.
I've never seen a company give awards out just for wearing your pants right. Because they don't want people crying that they didn't get one.
I've never seen a company not want to discuss products because every Merck rep is afraid to fucking talk about products in front of their peers.

A day at Merck; I drove around and dropped off education resources; um, so you did nothing? No, I am a customer rep and I bring much more to the table then everyone else. Oh, ok like what. Well, how's your EMR? Why? Because I care, how's your education resources. Why? Because I work at Merck. What the hell do you want again? I don't really know but I'm going to tell my CTL that I uncovered you like EMR and they will put this on my PMP and I will look good. Ok idiot, can you take out my garbage then? Wish I had been let go back in Jan '10, like you. Instead, as you say, I'm at this hell of a place. Hope I get cut during the upcoming round of layoffs....the severance won't be as sweet, but still a sizeable amount for me. For those of you under 50, get the hell out of here!!!

Wow, anger much? I'd love to know what it is that SP got done that Merck couldn't. All of the drugs failing now are from YOUR legacy pipeline. As far as most Merck folks are concerned, SP is just a big band of liars and cheats. Looks like the DoJ might have a similar opinion.
