i am out on leave and looked into this. Under FMLA your job is not secure if it is lost as part of a company reorganiztion which is what this is.

You get laid off as normal, but I don't think the WARN period begins until you are officially due back.

this issue came up in the Oct. 11 layoffs. My partner was on leave, my old DM could not contact him because he was on leave. Very similar to Office Space, I think he's still receiving a paycheck searching for his stapler.

No seriously, your position can be eliminated. Your severance will not begin until your medical release date. I could be wrong, a call to HR will answer your questions much better than CP.

HR here. You are terminated your first day back and all vacation time that you believe is due in 2013 will not be paid. Question comes up all the time since notice will affect those in this year into next year.

Use your leave time wisely if possible. You will be pfucked, trust me.
