RLT NON-COMPETE

In order to be considered legal, “compensation” must be given in return for a non-compete agreement. In this agreement, RSU’s are awarded but no monetary compensation is received until 2027. Is this a loophole we could exploit?

They would find a large proportion of reps to replace you. Don't over play your hand, you're barely an employee number on a spreadsheet when you work for Novartis.
The only way this will work is if you’re able to get 80-90% of people to refuse to sign under these terms. RLT would be decimated and Novartis embarrassed. They would bargain because it’s way less expensive than re-hiring an entire team. And they’d get less qualified people.

I’m speaking with an employment law attorney whose focus is pharma/device tomorrow… Considering creating a gmail address where impacted employees can write in from their personal email address if they are willing to pitch in on retaining council to attempt a terms negotiation. Would need to move fast. thoughts?

That is always a possibility but in my view the main purpose of the ncc is to prevent you from going to RLT competitors. They don’t want you to leave (voluntarily or not). Let’s be real: the “awards” are a joke and no one is staying because of it. I’m not sure employees are all that powerless in this situation.

thank you

They just promoted someone from Cosentyx to be the RLT general manager, that should tell you everything about this franchise. People making decisions at the top who haven’t a clue about RLT. We are living in a clown world.
And they put that person in a different role “Special Projects” for the first year at Novartis to circumvent her noncompete with her previous employer. The f’ing shadiness and hypocrisy of this company is unreal!

There is something going on here with favoritism towards certain women. I have been in the industry for a very long time and I have never seen so many unqualified or under qualified women getting promoted into roles they have no business being in. Just look at some of the recent promotions at the Director and ED level across all business units - in sales, training, marketing, patient services, operations etc. It is so obvious

You are entitled to your opinion but please share it on a different thread. This is about the non compete and non solicitation documents RLT is being forced to sign. Move on

I encourage everyone to talk to their supervisor and P&O and voice concerns. There is pushback and we all need to speak up, even if we have to sign in the end….the deal only benefits NVS and materially harms employees.
