Post layoffs class action

We have a case! The Janssen sales Director has told many Vertex employees months ago that Vertex is just asking for a class action lawsuit. We have an extreme case. Vertex would lose any case due to restricting the right of it's employees to work.

Here is the problem.....,when you get laid off you will get you 2 month severance, but before you take it you will be required to sign a document stating you will not take any legal action against ten company. If you sign document and take severance you legally can NOT TAKE LeGAL action. If you don't sign document you can aggressively go after Vertex and expose them for the lies, non compete, etc. The PR damage this will do to the company will be devastating. You have a very strong case against VRTX and will most likely win but the problem is you can't take severance! If enough employees do not sign document Vertex is in deep S$#%*!

But I need the severance - This is blackmail

Is this true?

It is...but trust me...the courts know this. Here is an excerpt re:Severance/Wrongful Termination/Statutory rights. The good lawyers know this and even if you signed a contract with terms and conditions deemed to be illegal or unfair by a judge or jury that part of your contract will be void regardless of severance or your"agreement not to sue".

Although the EEOC's position on severance-related waivers may seem contradictory, there is a two-part rationale that explains why an employee can sue for wrongful termination even if she signs a waiver. An employee's right to file a charge of discrimination with the EEOC is a statutory right under Title VII of the Civil Rights Act of 1964 and individuals cannot waive their statutory rights. Also, the EEOC has a duty to protect the public interest through identifying and resolving employment discrimination. Therefore, if the employee believes the employer acted unfairly, reporting unfair employment practices to the EEOC enables the agency to address potential violations of Title VII and other equal employment laws.

Is this true?

No. Not exactly, but the company will try to sell it that way. Then they will say to the court they acted in good faith, they are a great company blah blah blah. The court will see right through it. In any event, consult an attorney before signing. A class action will take time but a skilled attorney may be able to negotiate a higher severance, payout etc in the short term.

Vertex may think they own us but time will show them otherwise

I can shed a glimmer of light on the problems associated with 135. It seems as though the Intellectual Property was not as clearly defined as initially thought. Management now has two problems, one being clinical and one being legal. They have decided to pull the plug. I am truly sorry.
