Performance Plans

The leaders in this company are idiots that have never been outside this company.

Don't worry about getting fired, within 2 years you will be let go go because generic will kill this company and the executives are too stupid to see it.

What will be funny - these lame asses trying to get jobs somewhere else.

By the way, in a certain region, the numbers have been consistently horrible, yet the upper management remains and reps and DMs are let go. Why?? Why aren't the crappy RDs and ABD dismissed? What's that, this place is inbred?? Oh, got it!

Our stories are very similar. I was in the MW as well and my charge for dismissal was a bogus "failure to follow company policy."

My DM was cool (I thought), till all this went down. Sad story. Faithful as I stayed, I returned to my roots (science BS, completed an MS within a year) and work for a more lucrative biotech CRO...
My advice to any pharma "representative" is that know that you are as dispensable as tissue-paper. Do your best to have options lined up for life after pharma because sure as the sun will rise tomorrow, your tenure will end.

All the best, guys.

EVER soooo true!!! Hit forty and you are DONE...

If you don't pass the 60-day plan then you progress to a 90-day plan-more busy work. They are trying to push you out. You will not see any positive remarks on your FCR going forward. Document everything! Call HR on any and everything, get a lawyer if needed.

The advice to call HR is good but thats if you want to open a file against your manager with your name attached to it....call the Compliance Hotline as an Anaymous caller. They wll give you a file number and PIN to reference. You then call back in a few weeks to see what course of action the company wants to take. Good Luck

DO NOT USE YOUR NAME if you are going down this road!!!

You CANNOT, let me repeat, CANNOT record conversations etc. with someone if they are not aware you are recording them. It will never hold up in a court of law. It's not illegal to record a conversation but it's basically useless, unless you have the person's permission to record them. In fact, it could actually backfire. If somebody tried to record my conversation to get me in trouble I would sue the pants off the company. With that being said, if you think you're working hard and being micro-managed, start getting other irons in the fire. Update your resume and start looking at what else is out there. Life is too short to be completely miserable.

Happened to me too - MW over 40. I suggest to know how to handle, get advice from an Employment attorney. They will be able to help you with what and how to document. As far as recording conversations - states may have different regs but check out DSI's handbook. It addresses this in there...

This company wants little soldiers. People who do what they are told and do not ask questions or give any feedback. There is a total disconnect between what is going on in the field and what management wants us to say! They are trying to get rid of reps with experience so newbies have no idea how they are suppose to be treated!

Wrong! Wrong! Wrong! You can record any conversation without permission, and use it in court, as long as you are present during the conversation. It's considered to be like taking notes with pad and pen. You are not allowed to record a conversation you are not present at, however. My recordings between me and the HR dept. and between me and my DM have already been given to my attorney and also passed on to the company attorneys.

I've double checked that too. The catch is, if one part of the party (you) knows its being recorded that's all it takes.

So, if a DM has basically told me I suck, without using those exact words, along with other things. Whats my next step? Other comments are things like: you aren't a good sales rep, how can you live with yourself with these numbers, why are you even still here? I've been hearing these comments for a couple of months now.

It seems like its one thing to try and improve someone, but its another thing to be degrading (more has been said) to the point I can't eat, sleep, puke before FCRs etc.

Ummm..... you are not allowed to record a conversation you're not present at??? Yeah dipshit - how can you record it if you're not there?!?! The reason your recordings have been passed on is that your attorney is a dipshit. He/She is now giving the company's attorney's access to something they are not entitled to and they, in turn, will prep whomever you're accusing of how to respond. Let me know if this does, in fact, hold up in a court of law. It is NOT admissable. But go ahead and keep telling yourself it's ok. Joker.

Performance plans, recording conversations, asshole DM's and RD's - whatever folks. Our time for layoffs IS coming. This industry is NOT a career industry anymore and that will most certainly include reps, DM's and above. Keep your resume sharp and see what else is out there. Don't be afraid to interview on the company's time, you HAVE to look out for yourself and your family. The business model of the pharmaceutical rep is a dying star, don't get left behind.

Like the Seinfeld episode where George puts a recorder in his briefcase and leaves the meeting leaving the briefcase in the room. He records what he thinks the people at the meeting are saying about him. This is a joke that Jerry Lewis used to do this also.

Rode with my DM this week. According to her I am under-performing now I am now on a 60-day plan with about 10+ hours of extra busy work each week. I have only been in this industry a little over two years. Of course, I started crying but she didn't care. She has NEVER said one positive thing. It also sounds like there are many others on plans after talking to friends from training. Is this the direction the company is headed?

Also, If after 60 days I haven't improved then we move on to something else. Is there any chance of getting off this thing or is it formality from here on out? Also, what happens on day 60?

Any suggestions on recruiters or other industries that would good to work in?

AHHH-DUUHHH That's the type of questions you should have asked your manager when she gave that to you. No wonder she's giving you an Action Plan to follow.... If you don't even show initiative for your own concerns and doubts, how can she expect you will do the same for your territory... For you to be in this industry for little over two years now, you sure have paid more attention to CafePharma than to your development. Start working; you're not even supposed to be at home at this time you cry-baby!!!!

Based on the time you wrote this, it appears you had a "rough" Monday too.

I don't know if it varies from state to state, but in Texas I was advised by an attorney on the legality of recording conversations. It was not a topic I instigated, she was just "suggesting" by stating the law, which says recorded conversations are legal if one person knows the conversation is being recorded. So, I can legally record my conversation without disclosing to the other party(ies) that I am recording them. You are not allowed to record the conversation of other people (you must be party to the conversation).

Along the same lines, I was working with a counterpart who was a piece of work. She was a blatant liar, and from the start it was clear she was a manipulative person who would say just about anything to get me in trouble...fortunately, my DM saw right through her and suggested I record our conversations because the witch was telling her DM all sorts of lies about me. Sometimes, you have no choice but to protect yourself by any means. It is a good idea.

You cried???????? You deserve to be on a plan. Crying is crazy...it's a job, people are diagnosed with fatal illness everyday, children are sick, soldiers are dying, need I go on?Crying over a PIP, get out of this industry, it's not for you.

this is a joke, i just got put on a performance plan for 'not holding my managers accountable'. management has admitted something is going on with the mc market in this state but i am the scapegoat and it is my fault.
it is just sad...

Well...under Federal Wiretapping Statutes it is perfectly legal to record a conversation as long as one of the parties gives consent. Also, a good attorney should be able to figure out a way to get it into evidence....According to Federal Rule of Evidence 403, "All relevant evidence is admissible...", there is always a way to get it in....I don't know about giving the conversations over to the company's lawyers, maybe once it gets to the discovery stage but that would'nt be until the lawsuit had been initiated....I could be wrong but this is my take on it....

not true...check the state you live in. Where I live it IS legal.

Exactly, you need to check your state laws. Some states require that both parties know their conversation is being recorded. Other states, only one party needs to know and that party can be YOU! It all depends on if your state has an "eves dropping" law or not. Now the issue for those of you that CAN record a conversation without your DM knowing, is that legally you cannot go and play that conversation for a third party not originally in on the conversation unless it is asked for by the law or your companies HR department. If you play that conversation for say a teammate, you could end up getting busted so be careful.

I thought after layoffs PIP were behind us, but my partner has been getting ridden pretty hard from his manager, now is on a PIP.

This company is BS, my partner is a great worker and puts more hours in than any of us. I just dont get why a company decides they dont want someone anymore so they make their life a living hell.

These PIPs are mostly mind games trying to get the person to quit.

Are any of your territories going through this? what is going on? are people going on medical leave to get out of it?
