Summing up this lawsuit
Millennium had a non-compete clause with employee Dr. Pesce.
Non compete clauses are very difficult to win in California as it is seen as a barrier to the "right to work" and they are not very binding or enforceable.
However Dr. Pesce (the dumbass) USED Milllennium company computer to converse back and forth with Jim Plante/Pathway about being recruited over to Pathway and "what he specifically needed"
They entered into a non-disclosure and not even a summary judgment was reached.
Also Millennium would have to show how this harmed their profits and that is equally different to prove. Sounds like it's a case of Dr. Pesce leaving for what he thinks is greenier pastures at Pathway Genomics.
I am sure they lured him with big promises and huge salary increase. Hope it was worth it considering all the people they cut from Pathway Genomics not to mention the legal fees and possible cash settlement???????
