Overtime Lawsuit Questions

Alhough I do understand the qualifications to be included in the sertlement, but all sales reps should be entitled to overtime, not just in certain states. The job description is no different in one state than in another. Also, nothing has changed since 2007 as far as working more than 40 hours per week. If the company settles it according to the rules in the class action lawsuit, I do think there will be MANY more filed.

Since you don't know sh*t about the law, don't come to this board and act like you know what's going on, "I do think there will be MANY more filed." You do huh? You think the law allows 2 class action lawsuits for the exact same thing for the exact same time period?

I don't pretend to be a lawyer, although I did stay at a Holiday Inn Express last night, but I'm pretty sure you can only sue someone just once for the same "crime". Just sayin'
 






If joe b. continues to add more trackers I will personally sue for overtime. When does the company think we do all this extra work. I literally need at minimum 15 hours a month do do all the work that is due...the funny part is most of it is bs that no one ever even looks at. This company continues to talk about changing things but doesn't do anything about it.
 






No you did NOT have to sign anything. If you decided to opt out then you signed a document. Like most people I ignored the forms and I am still part of the suit. Call them yourself and they can check if you opted out. I highly doubt many people opted out. If you knew nys law then you would know you don't opt in...you can however opt out, which would be stupid. Please don't post false info on here. Check nys law if you don't agree.

I disagree. I think it's more likely that there has been a pattern of abuse, mismanagement, and harassment. companies don't pay out hundreds of millions of dollars over a few angry sore losers. The environment you work in is hostile and toxic. Stop blaming or calling out people whose only crime is pointing out the obvious. If companies like Novartis don't want to be sued or scrutinized then stop treating people in a manner where the only recourse is to raise their hand and complain. Novartis has great people working there from the top to the bottom, that has never been the issue. The issue however is how some people have been treated along the way. Unrealistic goals, unrealistic expectations and a culture of fear will lead to nothing but to an unhappy and disloyal culture.

You can't teach reps to endure the bullshit they will be subjected to in a role play. Seriously? It's 2011 and we are still training reps through role play. How about training reps how to endure a sadistic manager or the damage caused by an overzealous regional director at the helm. In all my years selling in pharma I have never heard of one rep driven nearly crazy by a customer, but I know of many reps brought to tears and Xanax by some douche bag sitting next to them in their car once a month.

I was hired in 2006 and received nothing to sign. I was told that since I signed nothing that I am not included. So, it is not for currently employed reps that live outside CA and NY. Did all employees receive the paper to sign and send back in? But, since since ALL Novartis sales reps are entitled to overtime pay under the Labor Laws, when is the one for reps from 2007 to present, in all states, going to be filed?

Kate Nelson phoned me today. My time of employment with Novartis ranged from 2008-2011. She did not say that I would not be included. She said the final decisions had not been made and I told her that if I have an opportunity to opt in that I definitely wanted to and she said she would keep me posted.

I distinctly remember receiving the letter about the overtime lawsuit. It was around the time we were launching Tekturna. I was doing 2 to 3 programs per week and working my ass off to get that product moving. So when I received the letter about overtime pay, I said a big "HELL YES" signed and hand delivered my "opt-in" letter to the post office. The timing of the notice could not have been better.
