Can someone please explain which states, or if employees from all states, are included in this lawsuit settlement? Also, did you have to be employed through
2006 to be included or is the settlement for current employees also?
 






Had to be in NY or California to be part of the class action suit, unless you "opted in"...this was way back I think in 2004 we got the paperwork...very few others joined. If you did not join then, it is too late....you can always double check with the law firm to see if there have been any updates.
 






Not true, I just spoke to the attorney who plainly stated that ALL reps will receive roughly 1300 per month for every month with the company. Former reps will be paid also. Pay date, early December 2011.
 






























I could see Novartis paying overtime to all reps to avoid further legal issues and to prevent an already lower morale issue but the 1300/mo sounds a little excessive.....1300/mo = 15k a year.....I have my doubts.

I would think there would be a statue if limitation that is applied. Who know? It shouldn't be much longer.
 






At this point I will take anything, but hoping for a score! Hate these pieces of shot they deserve to pay everyone a ton for all the unethical things that they have done to numerous reps over the years !
 






I dont recall receiving any paperwork re opting in or out. I would imagine to avoid further legal issues Novartis will address this overtime payout with all reps.
Can you imagine Novartis announcing a payout for overtime and signaling out a slect group of employees and ignoring the rest !

In other class action suits you are included in unless you decide to not participat.
 






stop speculating, call the law firm yourself...this was different, if you did not opt in in 2004, unless you lived in CA or NY you are not part of the class and not getting money...period...now grow up and accept the truth!
 
























Not sure who keeps taking these posts down, call lawfirm, the DC office, and ask for Kate Nelson, she will confirm....that this suit is not the same as gender suit...unless you lived in NY or CA, you had to OPT IN by 2007 in order to be a part of the "class" If you did not "opt in" by then, regardless of the final payout you will not get any money!

You really did have to opt in, no getting around it. Lots of people did not opt in for fear of loosing jobs or backlash after. If you go to the law firm's website, and then go to this action, you can put your name in and they will call you back. Too bad that you had to opt in, lots of people did over and above, but feared Big Brother!

Alhough I do understand the qualifications to be included in the sertlement, but all sales reps should be entitled to overtime, not just in certain states. The job description is no different in one state than in another. Also, nothing has changed since 2007 as far as working more than 40 hours per week. If the company settles it according to the rules in the class action lawsuit, I do think there will be MANY more filed.
