Non-Compete Clause

If your career hasn't progressed the way you had visualized and you fell short of your goals it's understandable that you may blame the organization. When reflecting back is there anything you could have done differently to absorb some accountability? You have posted your feelings on this website and are entitled to your own opinion but now what? With your passion and talent move forward and prove to yourself that the corporation made a major mistake letting you slip away.

Ive been gone and its progressed not the way it would have had I stayed with this shitbag. I actually stopped my career fro the SN death spiral. Your post is laughable. I guess the accountability is a hot topic across the country as SN is getting killed. So when all the numbers reset it will be rejoicing for the reps...except that they are too stupid to realize that with all the lost business it will be tough to make the new number because somehow you have to find the 12-16% in new sales volume from somewhere. Good luck pulling that out of your ass. At least some guys may hit 75% to plan so they will actually get a commission check to go with their paltry salary.
 












i don't believe you have the option- it was mandatory to being employed here for me. Also, before you try and test the non-compete, even for those that were laid off, you did sign off on responsibility for S&N's legal fees if they pursue you for a violation of the non-compete and win it.
It is unthinkable and incredibly cruel that you can be laid off from a company and then prohibited from working in your therapeutic area. But that's the way this industry works, not just here. I know it is a horrible feeling as i am in this boat right now with some of you.
 






I agree with the above poster. I was blown away that given the situation, they would be enforcing it. When it came down to it, the severance was more important to me than attempting to fight it. At the end of the day, I am glad I am no longer with this classless company. Unfortunately, if you do not sign the non compete, they can choose not to move forward with employment or lay you off.

Good for you. You just became more powerful than S&N. This organization is so insecure and afraid of any challenges. They think they need to have absolute control of their employees. The non-compete agreement is a key provision. They need to have that for leverage. Whether you ever compete or intend to compete with them, they can use that to sue you and tie you up with significant legal/court costs before it gets dismissed or settled. Most new people are excited for the prospect of making some money that they don't consider the effects of signing that... They own you and you better fall in line.

Don't know what the Healthpoint people are being told by their HR but I thought I would share my experience.

What is the rest of the story? Where are you working now? Do you have a job now?
 






ITI will fill gap so when SN tries re entrie. Where will they go? Kaiser, Dignity, Indiana, Texas, Duke, etc. no. When you pull what they did, impossible to re enter market, especially with Devices that do not alarm. Oh yea, picking up with Apria is not going to happen. Certain telling events will make re entry only at scab facilities and some LTC. This was truly the greatest lie ever told to the industry, particularly with the funding this giant has. Hell, the little guys out there have a better pump that actually alarms. The gross lying and incompetence reminds me of a certain Administration.
 












Just know that competitive companies to S&N know that we enforce our Non-Compete and will not actually hire you just because they want to talk to you. I interviewed with another company to find our and suspect they were just using me to "Fish" for competitive intel.

Ive been in FL for a while and seen a lot of turnover from this miserably run company and have been witness to VERY LITTLE ENFORCEMENT of the non=compete. As a 1099, unless you are back in the same territory the next week, or poach business (significant) these "documents" are worthless. Especially if you have only signed one from your date of hire.
 












What levels are non-compete clauses at? I have an interview coming up with them, but only at an associate sales role. I had heard about this before, and wonder if it something I should be concerned about.

Depends on the state you work in. Some states have right to work laws, in which a no compete would not be binding whatsoever. I know there are people who left SN Device Division and went to a competitor. Not sure of the law, but they left because the FDA shut down SN Wound Vac Division. I would assume this alone would negate any kind of no compete clause. Also, the Vac from SN was such a piece of garbage, it would be unfair, before the FDA shut it down, to call this train wreck, anything that was competitive whatsoever.
