No overtime pay for sales reps - the great and powerful Supreme Court has spoken

The irony is that now that we are officially sales people...we still have to drop off those samples, get the signatures and make sure the lunch is on-time for the office.
 




A few comments about this ruling. It is fair. Why in the world should you all get overtime pay for a job you work at 20-30 hours a week! You all are salary employees and get huge bonuses.

Don't blame the medical field b/c we are trying to do the right thing and not seem biased or swayed by reps. I remember back when I could have gone to the spa 5 days a week (no joke). Then there was the drop by our table at restaurant whatever and get a complete meal for your family (to go). I loved those cooking classes making food for your family (actually could have feed a small army). Useless trinkets - I have every coffee mug, stuffed animal etc. They even paid for us to have Epocrates for a year. If you became a speaker, even better b/c they would pay a huge amount of money for about 30 minutes (not really but close). Ridiculous. This one and other pharma companies should have paid attention to R&D a long time ago.

Doesn't matter who wins the election it won't matter b/c health care reform is coming and reps. will be a thing of the past.

It's frightening how abysmally stupid so many Americans are. Republicans have spent the last thirty years creating an American society where there are only the rich and the poor, JUST LIKE IT IS IN THE THIRD WORLD. According to the Congressional Budget Office, between 1979 and 2005 the inflation-adjusted income of families in the middle of the income distribution rose 21 percent. Meanwhile, over the same period, the income going to the top 1 percent increased by 275 percent and the income of the very rich, the top 100th of 1 percent of the income distribution, rose by 480 percent.

George W Bush left this country diving right into the the Second Great Depression. Obama saved us from that by some great work, even though the Republican attitude since then, as stated by George Mitchell, was "Our top priority is to make this president fail".

And you endlessly bitching about Obama. You sir, are as dumb than a rock. Welcome to America - land of the clueless, home of the idiots.

Have you ever lived in a third world country? I have. Do you have any idea what is like for women in those countries?

Obama is so confused because he lived in several countries overseas. Wrote a book that someone should have clued him that you never do that because it will come back to bite you - just like dogs will. His grandmother probably helped him the most.

Like I said it doesn't matter who wins the election. health care reform is coming either way. no MD or any other practitioner will make any money. We don't now because malpractice is expensive.

I know the law firm of Ms. Obama. I also know Ms. Clinton's firm.
 




Wow, it is so sad that we used tax payers dollars for something this stupid, perhaps its me but if you make 100,000 dollars company car, company phone paid company car insurance paid, bonus , 401k and pension.
How much more do you want. The only thing this would do is if they had to pay us they would have to get rid of us.
I am just glad that most of the Reps who signed up were the Reps who got laid off. Sorry about that I know money is scarce, but this was never going to happen. Now its time for you all to look seriously for another job and not wait for the Pharmaceutical fairies to drop money over your houses.
 




I don't think anyone was sure of the outcome until it happened. That said it's not suprising the 5 conservatives sided with industry over individuals. Just because we were well-paid doesn't change the fact that the companies classified reps as exempt which offered the companies clear tax advantages over not doing so.

I think in a way this ruling will be another blow to the pharma rep position. Doctors are acutely aware (and do pollings) of public perception of the profession. During the heyday of pharma excess doctors had the lowest rating ever for integrity. Since they have cut ties with industries (for the most part) it has climbed to its highest level ever. Classifying reps as sales people and not consultants or reps or promoters clearly indicates what you are and why you are there. This will not help your access or credibility to hcps..

anyway, good luck to all the reps still out there. Not an easy time at all to be in this field.
 




I can't imagine there were current employees who signed up for this? Is anyone aware of current employess as part of this suit?

Hopefully there's a list of those who did.....

We cut ties with your industry b/c the writing was on the wall. I can't tell you how many unethical things were said to me and my colleagues. We often laugh about it b/c how could you all get away with it? Granted, there are some unethical MDs, etc. but for the most part at least my colleagues/friends were never swayed.

Your industry put so much money into dinners, trips, tickets to concerts, spa days, etc. I never even wanted to go b/c it got to be a hassle. Then reps from the same company would show up 4 times a week. Always wanting to give samples. I would laugh and say we don't have any room left in the sample closet but perhaps in the supply room. What is up with that?

I was always friendly with reps b/c the are verbose and a lot are decent people. However, it has become a complete waste of time for me and many MDs feel the same way. It is a shame b/c reps. really could of been of value to us but I guess all good things come to an end.

Dear doctor,

Many of your colleagues demanded trips, dinners, spa days and worse. The teaching hospitals were some of the biggest offenders, and the most bipolar. They'd lock us out, but would have a Director of med ed call and demand that we sponsor some high-priced speaker that was not on our speaker panel. Or worse, they'd ask for funds to buy books for fellows and chiefs.
But by and large, I agree with most of what you said. We did this sh*t to ourselves with all of the giveaways, the crap clinical trials quoted in our sales pieces, and the 4 reps selling the same drug in each office.

If you are a doctor, I am the President of the United States! Your grammar indicates you are not even a high school graduate. Friendly with reps b/c "the are verbose"-do you have a clue what verbose means? Obviously not, because it is NOT a reason why one would be friendly with such a person. Also, it is "could HAVE been of value" not could OF. You are likely a rep because we have many who are just this stupid but you are certainly not a doctor.
