NEW RETURN STATUS FOR SEVERED EMPLOYEES

This may be true in some arenas, but Novartis is dealing with people's livelihoods --saying one good employee is eligible for re -hire but another just as good, maybe even better, employee is not because of the year he/she worked there. The example you gave is about contracts, but both football players were eligible to work and receive money. Your example is not parallel to this.

It is parallel. When you accept severance, you do in fact sign a contarct. This contarct spells out, among other things, return policy, payment, no lawsuits, etc. If you sign a contract agreeing that in exchange for this money, you can never return, then "you can never return". Its that simple. Id "I" sign a contarct stating that I must wait two years then am eligibkle to be rehired, well then i must wait two years.

I dont understand why anyone doesn't get this. If you dont like the terms, dont sign the contract/accept the money. PLEASE REMEMBER, SEVERANCE IS NOT AN ENTITLEMENT. THE COMPANY REALLY CAN LAY YOU OFF AND GIVE YOU ABSOLUTELY NOTHING, BUT TWO MONTHS WARNING!
 












The question is whether you would really want to return after being treated so badly? I certainly would not, even if they offered to triple my salary. I would not want to return to the uncertainty, ulcers and anxiety that came with working with these snakes. No thanks.

The only people who won't understand this are the ones that don't understand or know the law, like yourself.
 






So it is apparent people do not understand that severence aggreements are very loose and not highly enforceable. Example: I was downsized out of Novartis with a non rehire status. Oh, guess what, I got rehired and did not pay severence back. If they want you they will make exceptions. Any good employment attorney will confirm this for you.

Also, no matter what the severence says, there are so many ways to sue if you want. Any lawyer that says you cannot is not qualified in this area.
