Former sales representatives of Parsippany-based Biodiagnostic Laboratory Services LLC admitted today to conspiring with others to bribe doctors to refer patient blood samples to the firm, U.S. Attorney Paul J. Fishman said.

William Dailey, 41, of Wall, and Peter Breihof, 42, of Nutley, pleaded guilty before U.S. District Judge Stanley R. Chesler, sitting in Newark, to charges of conspiracy to violate the Anti-Kickback Statute and the Federal Travel Act, according to a statement from the U.S. Attorney's office.

Morris and Passaic county residents also have been charged in the alleged scheme.

Company president Davis Nicoll, 39, of Mountain Lakes; Scott Nicoll, 32, of Wayne, a senior lab employee; and Craig Nordman, 34, of Whippany, a lab employee and CEO of Advantech Sales LLC were charged April 9.

From 2006 to 2013, Biodiagnostic Laboratory Services and entities it funded paid millions of dollars to physicians to induce them to refer patient blood samples to the firm. From these referrals, the company received tens of millions of dollars from private health insurance companies and Medicare, Fishman said.

Breihof and Dailey admitted today to using phony lease and service agreements to bribe physicians to send their patients’ blood samples to the lab. Breihof and Dailey also admitted that they paid various physicians a fee per test on behalf of BLS in order to induce those physicians to order more of the blood tests than they otherwise would have.

Breihof and Dailey each face a maximum potential penalty of five years in prison. Each count also carries a maximum $250,000 fine, or twice the gross gain or loss from the offense. In addition, Breihof has agreed to forfeit $1,179,556, and Dailey has agreed to forfeit $558,405. Sentencing for both defendants is scheduled for Sept. 19, 2013.

The $$ they are forfeiting are unreal.....how much did everyone make on these deals? This is just the beginning....people are starting to turn on each other and point the fingers. It will soon come around to Phadia.

Doesn't karma suck?

You deal with CRAP labs you look like CRAP. Having your employees on the take from Russian Mafia labs,,, PRICELESS,,, especially to your shareholders, bad news will follow you for years to come.

CP should start a new board: "Mugshots and jumpsuits" for all those who sold their souls for money and thought they were too sly too be caught and lost. You guys/gals made your families proud I am sure. Where's the money going now? Lawyers and bail, ACE that.

You're right, especially because the moderators take down any post with the initials of the low lives that created this mess.....I might actually enjoy seeing who takes the fall for this

Funny that the lab got busted more than a month ago & not a single TFS employee has been arrested or charged.

You lowlife deadbeats need to get a life. When you fail to make ACE yet again, let's hear your excuses about how everything under the sun got in your way from making your number. Losers...

He never got arrested or charged, dickhead. He didn't even get fired. He left on his own.

Bunch of jealous little twats.

Duh....and why do you think he left??? Because there were so many great things going on here? Or b/c he had good support? No you numbnuts.... the writing is on the wall here, his good buddy MM is gone, he fostered shady behaviors that will eventually get caught, and his numbers are going to tank. Of course he left on his own.

100 percent false, arrested, why did he leave the managers meeting on the second day, stating "he had a family emergency" the feds were at his door. Not one person from Thermo has spoken to LC since that day. Why? because he was advised by the feds not to speak to anyone from Bio D and Thermo.

So now I ask you didnt LC get arrested?

How could he be arrested if he didn't have anything to do with bio d?? Where's the newpaper articles about his arrest

LC is a whistleblower and threw everyone under the bus. Just watch. The LLC is for MZ's company. He was consulting on the side for BIOD. LC knew and ratted him out. Just watch and see. TFS is coming down hard on everyone. Non-competes are in full effect

This could make some sense...MZ is a weasel and was telling reps to move business to BioD, and when it didn't work out they washed their hands of any responsibility to the reps who lost credibility. As for LC this could compute too, he would do anything to get ahead, that little fireplug. I interviewed with him and he was a twit....talked about his reps in front of others. But he and MZ are cut from the same mold, so LC whistleblowing is a stretch.
