It is against the law to retaliate against a whistle blower. The government is watching close to make sure this does not happen. I'm sure the whistle blowers are in contact with the government to report in if they think they are being retaliated against. The whistle blower from the Specialty division,Al H. is still with the company.

The government needs to stop getting in-between doctors and information they might be able to use for patients that are running out of options. This settlement and most (not all) of the many others over the last 10 years are little more than government shakedowns of the pharmaceutical industry.

Allergan should pay the 600 mil in pennies and the whistleblowers should be ashamed of themselves, enjoy your blood money.
 












That is illegal and the doctor could lose his medical license for it. That is importing drugs across the US border. It does not matter if it was made by Allergan. It is a US Customs violation.


As long as the drug is accompanied by a copy of a valid prescription you can import from Canada. (21 USC, Section 301(aa). Clearly the person who made the statement on illegality either works for Allergan or stupid or both.

Well I can tell you that we VERY CLEARLY promote off label...we say "DR, WILL U USE Zymar INSTEAD OF Vigamox FOR EVERY CATARACT SURGERY? HOW ABOUT FOR LASIK?" Um...that is "Off Label". I have tons of emails documenting this from my manager, old poa materials talking about use in surgery, and my MANAGER himself will ask my accts why they arent using it for surgerical prophylaxis if they're using a competitive product. Hell- I've even heard upper mgmt who rode w/ me do it!!! So there! We create surgery instructions for the patients on HOW TO USE OUR PRODUCTS around surgery, but we arent promoting it Off Label"? PLEASE- PLEASE- PLEASE FINE THIS COMPANY FOR PUTTING US IN A BAD POSITION! AGAIN!!!!

The promotion by the company has been off label with false claims and we all know most of the reps are still off label. I don't work at Allergan so I don't know if the current marketing materials are still off label, but it doesn't matter. The company was off label for a decade. The company was committing false claims, and probably still supports false claims but probably uses disclaimers now. The old marketing pieces are key.

As for the govt. Again the above negative posters are wrong. The district attorney steps in and reviews the case and pushes it forward almost immediately after it is filed (all who your lawyers know). It remains under seal while the feds interview witnesses and prepares the case. DO NOT let HQ trolls or stupid reps tell you that you do not have a case. I KNOW ophthalmics well and I KNOW alcon reps were off label with vigamox and that Allergan had paid consultants that committed false claims. I have seen it first hand, but I don't have proof of false claims otherwise I'd file that suit myself.

Even if the govt decides not to take the case, what have you lost? The complaint will be dropped and no one will ever even know because it was filed under seal. The complaint only ever becomes public once the feds go forward and serve a subpoena. In which case, you are stepping into a school yard brawl with a really big bad ass kid that has your back and if you win it's like hitting the lottery. It's the best chance you ever have of financial independence and oh yeah it's also justice for a decade of deception and unnecessary expense to the health care system, the government and the patients.

If the feds served Allergan with a qui tam complaint, Allergan would probably settle to avoid the massive penalty. I am expecting the same from my former company. The body of evidence is too damning to even bother fighting it. I assume you have the same dirt on Allergan. The benefit of having worked at allergan is that Zymar has the majority share of antibiotic, hence they have the largest penalty. Makes little sense for other reps at other companies to go after that antibiotic market. The reward is not worth the gain, if I worked at Allergan and had that evidence, I would file a Zymar off label case in a heartbeat.

After reading this thread, I promise you that somebody at Allergan will file that claim if they haven't already, it might as well be you.
