Wrongful death lawsuit filed against Eli Lilly over Darvocet







How in the hell can someone sue Lilly and call it a "Darvocet" death, when the patient actually took a generic made by a company other than Lilly?

That would be like someone suing Honda for a death caused by a GM product.

Can someone tell me how that works?

Well Lilly lawyers apparently don't have a clue.

Look at all of the hundreds of JNJ recalls over the past few years. At Lilly, a very large portion of the workforce is there solely to prevent recalls. But recalls are not that bad, really. After all look at how JNJ is thriving more than ever as some simple manufacturing issues are repaired. Why? Good lawyers.

Do you have any idea how many lawyers inhabit the corporate center?
 












As a legal matter, there was a case decided last year that set a precedent that the innovator company held liability for a generic version of its drug. Friggin ambulance chasers. I hope LIlly has let loose the private investigators. I don't know this "victim" or her family, but I'm willing to bet she had every risk factor for an MI known to man: high fat diet, family history, obesity, smoking-you name it. But of course, the wise ambulance chaser knows that Eli Lilly has more shekels to tap from than the Louisiana shrimpers. Maybe John Edwards can be retained (from jail). He can "channel" the victim as he has successfully done in the past winning large awards from ignorant juries.
