Actually, that is true. Its federal law that for layoffs that are sizeable enough to enact the WARN act, any employee over 40 is in a different class.
They have to be provided a file of positions and age of those retained vs not. Obviously, no names are provided.
Therefore, any company has to abide by sending out a "list".

Maybe only the people over 40 that were let go get that list and the rest do not. I think that is how it goes.
