It is encouraging to watch the discussions over how to handle the expected long term vacancy of Gifford's seat and there doesn't appear to be any plans to vacate her seat. It seems clear the 3-month statute in Arizona only applies to state level positions. But there is a major gap in the law and the people in her district are not being represented in her absence. It is amazing this hasn't been addressed previously but surely legislation could pass to allow an interim dem to serve until she is able to resume duties? There are critical decisions being made and each district has the right to have their elected officials there to represent them.
Is there any precedence for how this is handled?

The official website of the Office of the Clerk of the House of Representatives outlines situations in which a House member has passed away or left office. In those instances, the district is left without voting representation until an election can be held.
Incapacitating injuries and extended hospitalization are not, however, spelled out. The U.S. Constitution does not go into detail about representatives who are physically unable to appear in the House of Representatives for weeks or months at a time.
