Subpoena's

With Zelnorm's withdrawal and what are sure to be many pending lawsuits, how are the reps who were selling it off label preparing? Those reps who blew out the goals by selling the prep rather than the indications. Any idea what you're going to do when the subpoena's arrive?

Hope the awards and president's club trips and outrageous payouts were worth it...

And since Novartis is one of the few pharma companies that continue to write post call notes... all those nice notes can be used as evidence. Other pharma companies went to drop down boxes a long time ago. Not good!

Nice one takeda...your scare tactics are lame. Having Zelnorm taken off the market does not magically turn your drug into a good one. Are you telling all your PC docs to do a preg screen before using amitiza as your PI instructs? Keep killing babys.

How many reps convinced their doctors to write Zelnorm as a GI prep?

I even heard of many stating that they asked the doctor to just write for 4 pills so the patient could take it the night before the prep and then in the morning instead of the Fleet Phospho stuff.

All those reps that sold this stuff off label made big commissions and many won President's Club as a result.

Their District Monkeys were teaching them how to do it by role playing it word for word.

They should pull all the post call notes for the reps that won the trip to basil, get the shedders rolling! Hope you guys enjoyed the trip

call notes can be used for evidence in a lawsuit?

That is how the reps got sucked into the Merck Vioxx nightmare. They took the call notes that claimed safety. NEVER put anything questionable in your notes. You have created a permanent and legal document that can be used against you and the company. I don't know why Novartis doesn't use drop down boxes with canned messages. Especially when they hire a crap-ton of 20 some things that don't have real-world business experience.

Absolutely - especially if requested by DOJ. Also expense reports, email traffic, and speaker compensation. They also like to look at minutes from Senior Marketing meetings.

They would also question why so many high sales potential physicians are trained as speakers, regardless of their academic credentials.

However Novartis is above board and none of this applies.

Now how in the world would Novartis be able to identify which reps sold Zelnorm off label? A script is a script - right?

All they have to do is pull up shipping records for Zelnorm to Zip codes through Cardinal or other distributors. They can then compare the amount of product shipped with the amount of scripts generated. Example: if they shipped 20 bottles of 100 count Zelnorm to zip code 11111 (total of 2,000 pills) and that zip code generated a total of 200 scripts.... there's a problem.
That means the average script was only for 10 pills. Doesn't sound like IBS scripts does it?

For those who sold off label its now time to get a "cheap lawyer". The FDA will be investigating this just like they did with other companies and they always look at the top reps FIRST!

They are the ones who blew out the goal and couldn't have done it if they just promoted "on-label".

Don't count on corporate helping you as they willbe just interested in covering their ass and avoid high fines.

If they have their lawyers call you don't think they are helping and say nothing because its you vs Novartis vs the govt!!!

call notes can be used for evidence in a lawsuit?

Yes they can. Just ask some of the reps who sold for Purdue or the reps who sold for TAP. They all had their computers taken by feds and with a subpoena
the gov't can take it off the hard drives at corporate if need be.

If you put down too much info to kiss ass with your boss then you will be the "fall-guy" when the shit hits the fan.

Don't think that Big Pharma will bail your ass out as threy are only looking at saving their ass from the gov't.

BEWARE OF WOLVES IN SHEEPS CLOTHING!

Cover your own ass. If you feel like its been compromised speak to an attorney!!!!!!!!!!!!

Unfortunately, every one of the President's Club winners in N2 N3 and GI/URO will be scrutinized. Goals were blown out by reps who have historically not performed well. Even with our screwed up incentive plan, these reps never placed very high in rankings.

Im not sure thats tru everywhere. I know several N2/N3 that have ranked high year after after year.

I think all this subpeona stuff is a bit premature. You forget nothing has been linked to Zelnorm and just cause the drug was pulled for 13 cases which all had pre existing conditions doesn't mean all the reps that sold Zelnorm will be on the witness stand. This will not be another Vioxx. Just look at the facts only about 500,000 patients were taking Zelnorm compared to the millions on Vioxx.

I saw the first ad on TV last night...join the lawsuit lottery and hope you can shake down the defendant for $$$...

Glad I don't work for Novartis anymore. First Galvus now this...

Who said anything about Vioxx?

Fact is, reps sold this product off label and it was then pulled for safety reasons. That's why N2/N3 reps should be calling a lawyer and preparing.
