It's completely legal. It's been around for a couple years (before Valeant bought B+L). Patient has to agree that they will not seek reimbursement or count the out-of-pocket cost to get them out of their deductible or donut hole before the coupon can even be used. Patient also has to notify their Medicare plan that they are opting-out for just the one time Rx. Check out all the fine print. It's considerably long. Pretty sure the corporate attorneys and Medicare insurance plans would've shut this down long ago once they started receiving letters from patients saying they were opting out. Also, with all the scrutiny on Philidor the past 2 months, if the Med D cards were even remotely shady, they would've had the reps cease & desist to distribute and destroy or return all marketing materials related to them.
