Lawsuit goes forward:
A lawsuit alleging that Abbott Laboratories spun off its hospital products business to deny pension and other benefits to workers will go forward after a federal judge threw out the company's request to dismiss the case.
Judge Robert W. Gettleman denied challenges to the suit's legitimacy by the North Chicago drugmaker and Hospira Inc., the Lake Forest company created by the spinoff last year. In documents filed with the U.S. District Court for the Northern District of Illinois, the companies argued that laws protecting retirement benefits weren't violated.
The suit was brought by three former Abbott employees who said they were transferred to Hospira and then had their pension benefits frozen. Myla Nauman, Jane Roller and Michael Loughery allege that the division was targeted for separation because 70% of its workers were 40 or older. Many of the employees were hitting their peak salaries of around $50,000 to $60,000 a year, said Michael M. Mulder, a lawyer for the employees.
"A lot of people were about to cross over" to qualify for their maximum benefits, Mr. Mulder said.
About 8,000 employees are affected and lawyers want to seek class-action status, Mr. Mulder said.
