We may give you a little more this time, however deep inside the document you sign there will be section on unpaid overtime. As soon as you cash the lay-off check you will have settled you claim to any unpaid overtime.

I was laid off in December 2010 and in the document it states that you give up rights from a whistleblower suit. I did not sign for the severence package. I have seen other companies severence documents and none of them state anything about a whistleblower lawsuit. I guess Novartis knows that there is a basis for them and instead of doing the right things to prevent them they just want to pay off a few bucks and hide them.

Not true. I was also laid off in Dec 2010. The letter didnt say anything about whistleblower lawsuits or anything of the such. If it did, what page or section was it in? I want to go look it up. If so, I will scan and post on this site!

The title of the page is Agreement and General Release For New York Employees. It is under section B of Paragraph 2. Release of Claims.
B. I agree that this release of claims is intended to be broadly construed so as to resolve any pending and potential disputes between myself and the Company Releasees which I have up to the date of this Agreement, whether or not such disputes are known or unknown to me, including, but not limited to, claims based on express or implied contract; breach of the covenant of good faith and fair dealing; any action arising in tort, including, but not limited to, libel, slander, defamation, negligent or intentional infliction of emotional distress, or negligence; any and all claims for wrongful discharge; any and all whistleblower claims; any and all claims for retaliation; any and all claims for compensatory damages, punitive damages, equitable relief, and attorneys' fees; any and all claims based on or related to the Severence Pay Plan for certain Employees of Novartis Pharmaceuticals Corporation;......
The paragraph continues but you see buried in there it lists whistleblower claims. Most people do not read every word on every page that is given and it is easy to miss. Most people out of necessity must take the severence package.

Post #8 on this thread answers your response. Most people do not read every word of a multi page legal document. The document also stated under paragraph 1 of Company Obligations that ... and (3) this Agreement is not intended to cover any amounts which I may be awarded as a member of a certified class pursuant to a judgment or settlement of a class action currently pending against the Company.

That is why we are able to collect from the Gender Discrimination lawsuit and any overtime lawsuit.
Please read your legal documents more carefully or take them to an attorney.
 






There's also a clause that states if any section of the contract/agreement is found to be illegal/unendorceable the rest of the contract stays valid. So if the courts find that clause to be unenforceable/illegal you can sue. But without a doubt we were paid hush money. I took the money and ran. If there's a lawsuit that develops I'll join. Worst case they counter sue for severance back.

Still, while I feel for the plaintiffs on the descrimination case, if pisses me off to no end that my succubus manager who favored female reps is getting a payout for simply having a vagina (allegedly). There is NO karma.

You are absolutely correct. Can you imagine Novartis trying to sue a rep for their severance money because they filed a whistleblower suit? That would be hilarious. Even they could not find a lawyer foolish enough to have their name connected with a lawsuit of that type.
