Overtime Lawsuit Payout

Talked to Jen at the Chicago office. She said the checks were delayed as they had to go back to court. With the supreme court throwing out the case Novartis is fighting the settlement. Dec 15-18 was the dates to see if Novartis would truely have to pay or not. Good chance we won't get overtime since we are classified as salary workers.
 
















PEOPLE PUUUHHHHPLLEEASEE! They can't fight the settlement!!!!! They made the settlement because they were scared they might be forced to pay retroactive overtime for everyone! 99 million is a drop in the bucket compared to what they would have had to pay if the ruling fell the other way. The way company is saving a fortune and hedged their bets in a big way by paying this settlement.

The GSK ruling might not apply to Novartis, but it puts an end to ALL future actions which seek to collect leech-money from companies either due to laziness or pure stupidity of the employee. This settlement is completely pathetic, but what is worse is the complete lack of humility, common sense and human decency by these clowns who think they are going to retire from this payout. I work for Novartis and I declined any payout related to this overtime suit. It was made completely CLEAR to me that this job is not a 9-5, clock-punching, union deal. This job is about producing results and getting rewarded for it.
 




CP cracks me up..... a lot of BS, and from time to time, some truth and clarity....anyway..just called and talked to someone at claims processing department at Rust,and was told the following:
-checks were supposed to go out at the end of July, but because of administrative delays they weren't mailed.
- there are not going to be any more courts appeals, or legal issues that will delay the processing of the payments
-and lastly, checks will be processed and mailed soon, but no specific date has been set

you can call the following number and check yourself, they will ask for some personal information, 877-251-1448

once you get the money, spend it as you wish. This is truly the end of the Novartis ride for all of us who were once employed by this company.
 




Thanks to everyone who is genuinely trying to provide accurate information. I have been out of the industry for a few years now, but a lot of the BS comments I see on these boards remind me a lot of the type of people I used to tolerate on the job. Oh, there are the professionals, but there are so many that have really no clue about the real world. Haven't missed the job for a second since leaving, but I do have respect for the true reps that serve their customers with integrity. For the others on this board, I am sure that your mind's hamster is on its wheel trying to think of a way to bash this post. Have fun. And good luck to all who are patiently awaiting this issue to be resolved.

Just talked to Emily at SWH who I've spoken to many times in the past. She assured me that my check will be here by the end of next week, that many had already been processed by Rust and received by claimants already!

No one is debating that the big company lost. What's being debated is that some are getting checks next week like you said, while others like myself called the 877 number and were told that the checks were delayed in order to make sure that all claimants were represented properly. I was told that checks were going to be delayed a few weeks most likely mailed in September.
I called today and got this info.
 




Wonder if it is possible that one's state of residence plays a role in whether the checks are "free to be cut" or not. Clearly I'm not an attorney. Curious if anyone has noticed a trend in their state and what they are being told. I am sure that Rust is directed to be as vague as possible to answer our questions.
 




Just called SWH and confirmed the following.

The appeal period is over. The settlement stands.

Payout depends on multiple factors.

i.e:. Class one represents sales people in New York State (original class action) who were employed by Novartis for at least one day from March 2000 thru April 2007.

Exact payout estimate could not be given at this time.

Other situations will fall into different law suit classes and be eligible for different payout amounts.

While originally scheduled for August, checks are now expected to be sent in September.
 




Fyi: Rust has a bad reputation of delays. Look them up on Google. I am guessing they often delay payouts because the longer they can hold onto the payout money the more interest they can collect. If you have problems collecting from them, call the attorney office, not Rust.
 




Ok, you're all losers! My check came TODAY! So much for "appeals" so much for "delays" so much for "September" and all of the other B.S. you people are dispelling! $13,477 written out to ME!

Nice!!! How long were u there? What did your letter you initially got say? Meaning under 100k was it 8k or was it the smaller amount? Also how many years did you qualify for OT according to the lawsuit? Thanks

Contrary to misinformation that has been circulating around the internet, the Settlement is final and not in jeopardy. Due to an abundance of caution and a desire to ensure that every class member gets his or her fair share of the Settlement, the calculation of individual awards has taken longer than anticipated. Accordingly, we expect the checks to be mailed in September instead of August. This delay will not jeopardize the checks themselves; it will only affect the timing of the mailing.
