Well, they (reps) may have won but this article spells it out in black & white...How embarrassing to the industry is this?? PHARMA REPS DON'T SELL!

A U.S. appeals court added more weight to the argument that pharma sales reps are entitled to overtime pay. Overturning a lower court ruling, the three-judge panel in New York ruled that Novartis sales folks aren't exempt from wage-and-hour laws because they're neither true outside sales people nor administrative employees.
By the court's calculation, pharma reps don't close sales in the field at all. Indeed, in promoting drugs to doctors, they're not even dealing with the ultimate buyers of their company's products. And they're not administrative workers because they don't have much in the way of individual power or discretion.
"The effect of the decision is not only to reverse the trial court's grant of summary judgment against the pharmaceutical reps," plaintiffs' lawyer Jeremy Heisler told the New York Law Journal, "but to hold, in effect, that Novartis is liable to pay the reps overtime." Observers figure that Novartis may end up owing some $100 million in back pay.
In knocking down both of these defenses against overtime, the court's decision could ripple through the industry. That's because Novartis is far from alone in fighting off sales reps' claims for overtime pay; almost a half-dozen cases have been decided, mostly in favor of the reps, while similar cases are pending at Amgen and Serono. And this is the first appellate ruling that addresses both the outside sales and the administrative employee questions.
 






I am extremely confident that there's not been one seminal or innovative idea in the pharmaceutical industry in years. The pharmaceutical industry will dull your mind; destroy the potential for authentic creativity.
 






We don't sell....we are delivery people for the pharmaceutical industry who get signatures upon delivery. The real salesmen are the speakers (physicians from large teaching institutions, etc.) and Journal Articles.

Pharmaceutical Reps ARE JUST USED to deliver drugs, and get signatures. Most are young, pretty people who can't sell dirt to an ant. So yes, they should only work 40 hours a week and get overtime just like a FED EX person would.

I remember one young, blonde colleague saying when they wanted her to actually start detailing...."but I can't sell" let alone carry on an intelligent conversation.
 






I hate the fact that so many stupid, brainless reps give the good ones a bad name. If you truly deliver canned scripted messages and can not sell your products uniquely, then you should volunteer to be an hourly employee. If you are too incompetent to have independent ideas and strategies to succeed, then apply for job with Fedex to earn your "overtime". If all you can do is take direction and then spew out the same crap to your customers, then try working retail. Most pharma "sales people" are too lazy to actually work at their job and put in the brain power to turn around the recent negative bias that everyone outside the industry seems to believe. Wake up people. If you act like a delivery person and think like a delivery person, then that is all you will ever be. Sucks to be you.

Sounds about right...young, female, blonde! is there anything else being hired these days in pharma? pharma reps ARE "delivery" people. at least the fed-ex "delivery" people get to dress comfortably! sucks to be "us".
