No I’m not. I’m someone who really loves working here, but have a family to feed so I have to keep up with things.

I personally believe the defendants have made false claims in their brief, they start out with the assertion Amarin had a free and clear NCE 71/2 years of unmolested exclusivities; we all know this isn’t the truth but Amarin has not prosecuted this fact as aggressively as they should have. Bad strategy that nows comes to bite us.

Also it’s unclear how bad the defendants spinned Budoffs testimony to claim 20% of scripts will be less than 12 weeks; their statement is firm and Amarin has no way to point this out. We have to hope the judge sees the statement as a stretch or even false.

My major point is this is risky for Amarin to assume a clear and convincing win with no chance of a very time consuming appeal. An appeal will completely take BO off the table.

Amarin should settle this.
think if Amarin wins (which the probably is ~ 80:20) the defendants get an appeal. Chance of appeal >95% with above argument.

If generics appeal I think it’s clear both Thero and Kennedy should be terminated immediately by the board. This case should have settled.

It might be prudent to act on Thero and Kennedy prior to decision by Judge.
