No compete?







They can and will use the non compete but it really depends on who you have posses off within the company. Why on earth would you want to go to Competition, they are facing the same issues we are. Go to implants or aesthetics sales.
 












it also depends upon what State you live in. Different states have different policies/laws regarding non-compete contracts.

As an example, California is an employee-favored state regarding these laws. You can sign a contract saying you will not compete, and if you live in the State of California, the contract provision for this is void in the courts of California, and no action could be taken against you.

You can call on same people but you cant sell a comparable technology to the same people or to be more specific in the same geography as before.

Cant leave JNJ and go sell for covid. Unless its a completely different division. No one will hire you and wait for the non compete to expire because you dont have strong enough relationships where you could take business with you. Suture and closure devices are contract type sales and companies figure anyone can come in and manage that business. Entry level sales jobs. Now in Ortho/Spine or capital companies will hire you and put you in another territory until your non compete expires because they know that is a true relationship sale where you can actually take business.
 










































Advice Please!!!

I'm still in my 90 day "new hire" probation period. My company just lost their contract in my state to their biggest competitor. There is nothing else local within my company now. Would my non-compete agree me still be enforceable? I know the competitor is actively looking for candidates.
