There is a thing called "teaching a lesson". There is one thing being a bad CEO and another one is having and knowingly doing illegal dealing and etc.

US attorney office will look through all evidence and will make the right decision. Being stupid can not and is not a defense for a CEO who has possibly stolen money from Shareholders by selling and or entering illegal trades. Not only CEO, but Board members as well as CFO, Chief legal and yes, good old CSO and CMO will pay for their illegal activities.

Legal wire taps, witnesses and etc are part of gathered materials. Stupidity of CEO, VP of communication, CFO, CSO, CMO, Chief legal and etc is that they have said too many things in their communications and meetings. All you have to do is follow the conversations and you will see the money trail. All of them are dirty despite innocent look and playing stupid.

So, good luck. Governor shave gone to jail for conspiracy to committ illegal act. CEO of small biotech is no one near that.
 












The positions you mention are the top of the hierarchy-aren't the managers or directors that submitted reports and statements just as guilty for duping investors? When you think about what is stated in your post- that would have be quite a conspiracy (below the EXC) to falsify financial statements and projected earnings based upon statistical analysis reported each quarter.
How could the managers/directors not know the projections were false? They are the ones number crunching and submitting the reports. How could sales not know the projections were false as they are the front line.
Think about the number of employees that would have remained silent and involved and not one was a whistle blower?

From what I have seen on this board there are lot of people who knew the projections were false. I have also seen on this board that the people who were supposed to come up with the projection number came up with 240M and it was willfully ignored by management. The people who came up with the 240M number did their job. They can't control what management does after that. Salespeople can know the projections are false and keep quiet to keep their jobs and continue to feed their family. That is generally what people do.

It is management that goes out and tells investors the projections. Management is ULTIMATELY responsible and MR HAMM IS A HUGE PART OF THIS for signing off on documents he should have never signed off on. It seems he was being loyal after cashing out 15 million and then another 2 million before he bolted the company.

lol hans false report in september is why dendreon is going to fall 150 million short of low end of guidance and 200 million short of high end. the only companies who ever miss in the 100's of million are companies that earn billions a quarter and even that is rare. this is probably the biggest miss of all time for a company projected to earn 350M by its management.

hans isnt going to get away with his crimes either. theyre all complicit in this.

Thank you for the clarification. One can only fathom the toxic environment of working at a place where employees know the truth and remain silent in order to feed their family. Talk about a dilemma of ethical considerations and personal values. As for the people that came up with the numbers and did their job and remained silent.. hopefully the investigative authority will hold the same opinion as well as the legal system that management holds the ultimate responsibility. What an uncomfortable position to be placed-knowing the truth, knowing the numbers, and having no power in the corporation or protections in place to stop the fraudulent activities. Talk about being vulnerable within a system. Discussions on this board have noted DNDN will become a text book example for future MBA students; it may also become a text book example of powerful corporate psychopaths for future psychology students.

you can get an idea of the toxic environment by reading the posts here. the law understands that management is ultimately responsible. in my opinion there is no way that the people who came up with the 240M (this is still going to be too high but it was a reasonable attempt) have any legal liability whatsoever if they did not come forward. many i'm sure have even left the company by now. this 350-400M lie by management first came out in November 2010 and was reaffirmed throughout 2011 until August 3rd. additionally the chief compliance offer was let go shortly after the lie hit the fan and these employees no longer even had a chief compliance officer to talk to. to this day, as far as i know that position has not been filled. if anyone within dendreon reading this can shed light on whether or not the chief compliance officer position has been replaced please do.

i hope my post successfully illustrated my sarcasm about han's report to mgmt being the crux of this huge debacle. hans is certanly complicit but mitch and schiffman and hamm are the main people who were ultimately responsible for this train wreck.
 






Hans could not say anything before Mitch and Board approving it. No doubt he was stupid but CEO and others in EC are responsible as well. Ask for knowingly forecasting wrong sales projections in order to keep the shares up and sale while it is high, well, as far back as Sept 2010, there are evidence such as e-mails to Mr. Gold and yes, he is not a Urologist who claim h is, he never finished his residency and does not deserve to be called Doctor either; any how Gold and other members of EC and Board were warned by commercial team from SVP of Global Commercial at the time to junior Director of Market analytic that it is impossible to achieve forecasted $350 Mil. Feds have all these records, yes, there have been whistle blowers.

No matter how much Gold and others try to erase data, they can't. So, be patient, example will be made and maybe Gold as a half A.. Urologist want to be, can practice on his inmates. Be patient.

when you say he's not a doctor do you mean there is no record of him being a doctor? if that's true it is illegal to represent himself as one.

your insight is really appreciated. like you i believe that good will win out here. laws were broken and horrible things have happened due to the actions of these sick people. gold in prison would be amazing poetic justice.

i understand that you don't know how long the feds have been investigating but how long have you known that the feds are investigating? it would have to be at least as long as you know about it so that would give some idea.
 






He is a M.D. But he never finished his Urology residency. He can claim he is a Doctor but one who has never finished residency nor has preacticed medicine apart from his incomplete training.

I can only say that Feds had start looking at Dendreon 2007. From my understanding, they are multiple investigations by various Federal agencies. My suggestion is get a good attorney if you are reading this and are VP or above in Dendreon.
