Free speech, PhRMA? Not in this off-label marketing case, feds say

This Fierce Pharma Marketing article discusses the debate surrounding off-label marketing as a free speech right. The DOJ has indicated that this should not be the case, in briefs filed in a whistleblower suit against Millenium Pharmaceuticals.

What are your thoughts on this issue?

If a person can't say anything they want publically on Facebook (for example) using their bosses computer, without fear of repercussions, under the law, it follows that a person, working on behalf of a company should not have free speech rights to make up any bs they want about a drug and spread it far and wide. Both individuals are both working for a company, and/or using company resources, or names, to spread their tales or viewpoints and are therefore not speaking as an individual but as a part of a corporation. So remember, only write things on the internet using your own computer and do not use your company's name in vain. Do not lie or cheat, either, while I am on the subject. Then all will be well.
