Recently the HH company that I work for "restructured" their sales plan for giving credit for referrals/admissions. They conveniently sprung this change on us in February, making it retroactive to January 2011... The end result, I lost credit for 18 referrals!
Due to this change it has greatly affected my bonus potential. I am so ready to move on to another agency but I have a non-compete.
Does anyone have experience with contesting a non-compete? Feedback PLEASE!
 




Don't have direct exp with a non-compete, but it seems to me that if they change something out from under you that negatively affects your compensation, you have a right to go somewhere else that is more fair. Is there a clause in it that exempts you when something changes? (read the fine print...)

Get a good employment lawyer because oftentimes "non-competes" don't hold up in court. Most HH cos. know this, but know that most reps don't know this. Fight it! Call the EEOC or Labor Board. They must pay you your bonuses on the 18 refs you brought in! RUN TO YOUR BEST EMPLOYMENT LAWYER TO REVIEW YOUR CASE! Most will take it on contingency...at least get your pay! Good luck and let us know how it turns out. :)
 








I just went thru this. when they changed this on you, they should had made you signed a new NON-compete if they didn't then you will have avery good case to get out of your non compete.
 




Unless your non compete has a clause in it that references your bonus plan it will still stay in place. If it does reference your bonus plan then you should have another non compete document that replaces the old one. Most companies do not reference the bonus plan in the document. Check yours out and see. I have found that a lawyer will tell you to uphold your non compete for the restricted time period. The cost of fighting it ca nbe very high.
