Do we have a lawsuit for Warn Act Violation??

In reviewing the federal and individual state laws, did Vertex violate the Warn act by not providing a 60 day notice to all affected employees? I'm going to contact an employment attorney for verification.

An employer who violates the WARN provisions is liable to each employee for an amount equal to back pay and benefits for the period of the violation, up to 60 days. This may be reduced by the period of any notice that was given, and any voluntary payments that the employer made to the employee.

That last line in the WARN provision was clearly covered by that BIG ASS CHECK they sent us.
 






Anyone who thinks s(he)'s gonna have any recourse at all here and is worrying about hiring a lawyer is really wasting time they should be using getting a new (better?) job, and money they should be saving.

Vertex has grown a very bloated legal dept. --- now we know why: to deal with all the employment matters and layoffs happening. Shakespeare was right -- first get rid of all the lawyers. How many of them got let go last month?

Talk is another 12-15% in the labs. I cannot take this stress. I still remember our colleague's - how they were treated when they were cut. I do not want to go through that. I hate to say that this kind of treatment is beneath me, but - I really think it is beneath anyone. Thoughts?

I went through this when Sanofi bought us while I was at Genzyme. As the weeks rolled by after the acquisition and layoff rumors were swirling, we became convinced part of the plan was to freak us out so that people would leave voluntarily. Many did leave on there own, and it made the final layoff smaller. Just my observation on what leadership might be trying to do here.

Yes, leadership there needs an attitude check. The disrespect the employees cut received was unnecessary. The worst part is they were planning it for a while and lied to everyone. Typical vertex
