Can the Supreme Court create new legislation replacing Title VII with pfizer's dei initiatives? Please, and thank you.
Sure they can, "In 2020, Supreme Court Justices Samuel Alito and Brett Kavanaugh dissented from the majority's decision that Title VII of the Civil Rights Act of 1964 prohibits discrimination based on sexual orientation and gender identity." The Supreme Court creating new legislature wasn't good enough, kamala and dementia man had to take it a step further and break both the original law and the new one created by the Supreme Court. A nice guy told me about those dissenting opinions, read them.The Supreme Court does not create legislature but congress can.
The Justices should reread Title VII and the dissenting opinions, then revisit their interpretations asking themselves if they created something new or not. In my opinion, they created something new.Constitutionally, the only role of the Supreme Court is to interpret law, not make it.
