Cephalon received a subpoena from the US Attorney's office in the Southern District of NY. This is the most powerful US Attorney's Office in the US and gets the highest profile cases...and they don't lose. This subpoena is for off-label promotion of Treanda, their top selling Oncology drug. Teva will end up paying up to $1bn in fines because Cephalon is a recitivist company, currently in their 3rd year of a Corporate Integrity Agreement. That meants the fines are usually calculated at 3 X damages. Teva shareholders may want to rethink the hefty premium they paid for this house of cards. Furthermore, all of the high level people named to positions at Teva are involved in the wrong doing.
