Abbott Laboratories will be suing PLUS dx

PLUS in its infinite wisdom is allowing its sales force to refer to the FISH test they offer to urology clients as Urovysion. Some reports from their crap labs still put Urovysion on the test report.

The real Urovysion test is a trademark of Abbott labs. PLUS developed a similar test and offers it to clients, most of whom think they are running Urovysion. Unlike PLUS's test our test is FDA approved and has been scrutinized in numerous peer reviewed trials. If you work with PLUS you should know you are NOT running Urovysion on your urine cytology specimens, but in fact are billing patients for a test that has not been FDA approved or even validated externally.

U don't have to worry. MINUS cant even afford to buy the probes anyways, so they won't be competing much longer.

I heard we were cut off by Abbott, and any income earned from billing this assay will be taken back once Abbott tells Medicare, which they will do as part of the lawsuit.

Here is what I know of the situation

PLUS sales reps continue to market the test that they developed as Urovysion that has been enhanced with their cell enrichment process, which by the way is bogus. The probes can be bought from other vendors, so even if Abbott refuses to sell to them you can still obtain FISH probes targeting the same loci and thus implement the method that Abbott patented. This tends to really piss off Abbott for another company to claim their test is Urovysion and then to turn around and purchase the probes elsewhere.

There are a couple of problems for PLUS. First of all the urologist who work with PLUS still think that they are running Urovysion on their patients urines and have no idea that the test they run is not FDA approved and has not been validated. Considering the low quality of the lab and questionable ethics (everything they offer is either illegal or exploiting a loophole around an obvious illegal act) I would not trust their internal validation.
