Supreme Court will review overtime pay for reps

    Would the role playing to India at 9:00pm count as overtime?

    Since most reps really only work a couple hours a day, this really looks like a non-issue.

    To the last post: Actually it's a huge issue! Other big pharma companies have had to pay and pay big! This could cost GSK hundreds of millions. As to your comment about a couple of hours, please stop with that nonsense. I avg about 9 hrs per day. It's not back breaking work (that's why I went to college) but it is work. Inventory at the storage facility, lifting boxes, conference calls, emails, coordinating lunches/dinners, knowing and understanding the complex molecules and how they interact invivo/invitro, analytics, ability to utilize Microfoft word/excel, intrapersonal skillls, the list goes on an on...oh but you say reps only work 2 hours. When are reps supposed to answer email, voicemail, build a business plan? On their office day? Ohhhh that's right, there is no office day. So when does all this work get done? According to you we only work 2 hrs a day. C'mon dude! Look, I'm not saying the law suit is a good thing, but the pharma companies had their cake and got fat eating it.

    The problem is that if overtime has to be paid out it will lead to more cuts. Lets face it, the impact of reps has been going down for quite a while. The other thing is that there will be more scrutiny over reps because we will become "service" employees. This will be a similar model to UPS / Fed Ex etc. Log in.............track activity..........gps............clock out at 5:00 pm. The small payout will not be worth it.


    To the 9 hour a day worker...............LMAO!

    I think you meant to say 9 hours a week. That would probably be more accurate.

    Troll! You are a lawyer looking to stir the pot. Overtime would be the worst thing to happen to our jobs, but the BEST thing to happen for YOU, since you would make a percentage. Logging in, logging out during the day...this is a flexible job that does not ascribe to 9-5. Beware what you wish for...

    GSK is going to lose this case. The Supreme Court already refused to hear an appeal by Novartis after their reps won in lower court. This what the Supreme Court does when they agree with lower court's rulings. Essentially, they've already said that they feel pharma reps are entitled to over time.

    The Supreme Court hears cases to over-turn them.

    Eventually, we all win. No more b.s. role play studying on our own time. No more studying for exams on our own time. NO more antiquated computer systems that waste hours of our time. GSK will no longer be able to afford giving us b.s. busy work to do on our own time b/c they'll have to pay us if they do.

    We all win.

    VRIFter here, this could cost GSK a lot. I remember signing paperwork that freed GSK from liability unless they were found guilty of breaking the law. Every VRIFter could get even more!

    VRIF was for reps to jump ship before getting fired......overtime is a joke son.

    This is the most ridiculous waste of money I have ever heard of....there are many more important things going on in this world and many people that can't even get a minimum wage job with a Masters Degree in this economy....stop whining about working over time...that is life..we are lucky to have jobs and still be in the industry...if you want out you can go.

    GSK is an unethical company. When they've lawyered up, lied, cheated, stole, fought to the bitter end and have lost- that's when they come out and say "we've made some mistakes... we cooperated with the government... we are transparent..."

    How authentic is an apology for wrong-doing when you've been caught red handed and lied to try and cover it up?

    This OT issue just falls in line with the GSK way. Add it to the list with the P.R. production cover up, the Avandia cover up...

    This company will stop at nothing to try and make money- regardless of the cost.

    Check your personal information on the HR website. We are paid for 35 hours a week. If you do a lunch, then you should not be working 8:30 to 5.

    This person is right. They took this info off of the paychecks years ago. Print out the info from the HR site showing the 35 hours and hold on to it. You may need it in the future. Also log any hours before and after work that you are doing work. You may need that too. This is a double edge sword. The company will have to pay out and from what I have heard the executives already knew that a few years ago when they were interviewed by the company attorneys. Apparently there were documents from both the DSM and RVP level that had "contracts" that the reps would sign saying that they would work 8-5. That was one of the majorly damaging pieces that could hurt the company. The other side of the sword is that this will now be a culture of signing on to your ipad in the morning, punching out for lunch and taking required breaks, then checking out at 5. All work will have to be done between 8 and 5 and overtime will only be allowed if approved. Although the hours of 8-5 will be the primary hours you will have no flexibility as your travels will be tracked. At least you will get your evenings and weekends back.

    To Post 16: I'm completely fine with the time stamping of the iPad. It's going to be a welcome change and field management is going to be pissed off about it. Picture this...a field contact with your TSM..you legally get two 15 min breaks and a 30 min lunch..TSM will need to take a hike. That is "your time" no work will be allowed. Too funny.

    As far as gps and time stamped sigies, no problem. 5 pm i am done! no more early or late afternoon confce calls, no more late dinner programs, no more studying in the evening, or else...we get paid time and a half. Bring it on!!!!!!!!!
