BMS Oncology suing reps

    BMS Oncology why are you embarrassing yourself suing sales reps that leave? You are such a spoiled baby. You don't want to give pay increases to loyal reps, you create a metric nightmare POD environment and continue to hire inexperienced reps. if you don't want the experienced reps enough to pay them why sue them when they leave to other companies? Spoiled, jilted compamy continuing to embarrass yourself in the industry.

    This post must be from an internal BMS person who can't get a job anywhere else? You are jealous that everyone is leaving BMS and nothing BMS says or does is valid or true. People leave BMS and go to competitors in oncology constantly.

    Did you sign a non compete? If so than you can cry all you want but they have every right to sue you

    2. Resigned to a 30k base raise, 20k signing bonus, no POD. Very happy
    3. Live in a state where non-competes are illegal. BMS can threaten all day long but in the end it is a harassment lawsuit with no teeth. We signed confidentiality agreements, not non-competes. There is a difference.
    4. Maybe you would be happier if you left BMS too. Just keep meeting your OOD for breakfast and logging fake calls. BMS loves them apples.

    People are being sued. So sad. New reps signed non compete. Existing reps received stock options which includes a non compete clause. Giving $5K stock is the cheapest way to ensure reps don't go to the competition. Good thinking BMS. Bad for reps because they can not continue to advance their careers in a field of interest. Which oncology disease state is Opdivo not going to be indicated in with all the studies being done? Limits possibilities for movement to other companies.

    Check your state law. California doesn't recognize non competes.

    5K Bahaha. Who in their right mind would sign a non compete for 5K? That should tell you everything you need to know and not take the job.

    Get a lawyer. Courts rarely enforce non-competes. Tell BMS to fuck off.

    Anyone that would sign a non compete for only 5K is a complete bozo. BMS is cheap and if you honestly think that 5K is worth putting handcuffs on the future of your career you deserve to stay at BMS. Don't think for a minute that they won't get rid of you when they realize they have too many reps.

    if BMS gets rid of you rather than you quitting then the non compete is null and void - not that they are enforceable to begin with

    I never heard of anything like this. BMS better stop this and POD selling and metric mania before it disintegrates as a force in oncology.

    I can't believe how corrupt and juvenile this is. Bad business.

    I know from experience that this organization is absolutely terrified of lawsuits as well as bad press. The pharmaceutical industry has a horrible reputation these days and BMS knows it's one NY times drug pricing article away from disaster. If conflicts go to court it's a single employee against a corporation with a horrible image and BMS cannot win. They know this. I don't believe that they are suing anybody on non-compete agreements. I did hear that some nasty letters got sent to former reps but that's it.

    This company does not enforce its own compliance rules around age discrimination, harassment and retaliation etc. if you ever feel you are a victim of the aforementioned, the organization will not support you. They will try to discredit you and dismiss your claim while creating some evidence that they "looked into it".

    Document everything and if you are in a state that allows you to record someone's voice do it even though it is a violation of company policy because if you go to court company policy doesn't matter only the law matters.
